r <br /> BILL NO. <br /> ORDINANCE NO. 8 2-94 <br /> AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br /> INDIANA, AMENDING CHAPTER 2, ARTICLE 14 OF THE SOUTH BEND <br /> MUNICIPAL CODE BY THE ADDITION OF NEW SECTION 2-170.2 ENTITLED <br /> POTAWATOMI ZOO NON-REVERTING CAPITAL IMPROVEMENT FUND", NEW <br /> SECTION 2-170.3 ENTITLED „MUNICIPAL GOLF COURSES NON-REVERTING <br /> CAPITAL IMPROVEMENT FUND”, AND NEW SECTION 2-170.4 ENTITLED <br /> "PARK AND PICNIC FACILITIES NON-REVERTING CAPITAL IMPROVEMENT <br /> FUND" <br /> STATEMENT OF PURPOSE AND INTENT <br /> The Common Council recognizes that pursuant to Indiana Code § 36-10-4-16 (g), <br /> it has the authority to establish by Ordinance special non-reverting operating funds and <br /> special non-reverting capital funds. In each instance,the establishment of such funds are to <br /> be requested by the Board of Park Commissioners. <br /> The Common Council recognizes that in 1988 it established the "East Race <br /> Waterway Promotional and Development Fund" by the passage of Ordinance No. 7886-88. <br /> This dedicated fund is used to receive monies and all interest earned on said monies for the <br /> purpose of promoting and developing the East Race Waterway. <br /> The Board of Park Commissioners of the City of South Bend will be adopting a <br /> Resolution (copy attached) requesting that three (3) separate non-reverting capital <br /> improvement funds be established. The funding mechanism for each new fund would be <br /> the increment increase of selected user fees and charges addressed in that Resolution. <br /> The Informal Mayor/Council Session held on November 17, 1992 outlined the <br /> short and long term goals of the Park Department. The Park Board has determined that in <br /> order to provide and make available to the public,quality park facilities and programs such <br /> as the Potawatomi Zoo, the Erskine, Studebaker and Elbel Golf Courses and other parks <br /> activities, that an increase in fees will be necessary. It has also been determined that the <br /> amount of the increment increase of each of the selected fees should be deposited into <br /> separate non-reverting funds. <br /> Accordingly,the increment increase of the fees for the entrance to Potawatomi Zoo <br /> would be deposited into the Potawatomi Zoo Non-Reverting Capital Improvement Fund; <br /> the increment increase for green fees for the use of Erskine, Studebaker and Elbel golf <br /> courses would be deposited into the Municipal Golf Course Non-Reverting Capital <br /> Improvement Fund; and the increment increase or new fees related to oven rentals and <br /> obtaining permits for the use of alcoholic beverages at specific park locations would be <br /> deposited into the Park and Picnic Facilities Non-Reverting Capital Improvement Fund. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF <br /> THE CITY OF SOUTH BEND,INDIANA, as follows: <br /> SECTION 1. Chapter 2, Article 14, of the South Bend Municipal Code is hereby <br /> amended by the addition of new Sections 2-170.2, 2-170.3 and 2-170.4 which shall read <br /> in their entirety as follows: <br /> Sec. 2-170.2 Potawatomi Zoo Non-Reverting Capital Improvement Fund. <br /> (a) The Potawatomi Zoo Non-Reverting Capital Improvement Fund is established <br /> pursuant to I.C. 36-10-4-16. <br />
