A <br />RESOLUTION NO. 3073 <br />ESTOPPEL RESOLUTION OF THE SOUTH BEND <br />REDEVELOPMENT COMMISSION <br />WHEREAS, the South Bend Redevelopment Commission (the "Commission "), the <br />governing body of the South Bend, Indiana, Department of Redevelopment (the "Department ") <br />and of the Redevelopment District of the City of South Bend, Indiana (the "Redevelopment <br />District "), exists and operates under the provisions of IC 36 -7 -14, as amended from time to time <br />(the "Act ") and is a body corporate and politic; and <br />WHEREAS, the Commission has now acquired certain property more particularly <br />described at Exhibit A (the "Property "); and <br />WHEREAS, pursuant to and in accordance with IC 36- 7- 14 -22, the Commission has <br />completed all acts necessary for the sale to the public of the Property to -wit: the Commission has <br />caused two (2) separate appraisals to be made by independent appraisers; the Commission has <br />prepared offering sheets for the Property to be offered and the offering prices, which were not <br />less than the average of the two(2) appraisals; a notice of the offerings was published in <br />accordance with IC 5 -3 -1; at the time fixed in the notice, the Commission stood ready to receive <br />bids for the Property; no bids were received by the Commission for the Property; and more than <br />thirty (30) days has elapsed since the time fixed in the notice for the opening of bids; and <br />WHEREAS, the Commission now desires to affirm the disposition actions for the <br />Property taken by the Commission and to authorize the Department, through its staff members to <br />dispose of the Property by way of private negotiation, carried on by such staff members, <br />including the adjustment of the offering prices in the manner the staff considers necessary to <br />further the development plan, and subject to the Commission's final approval of such <br />negotiations. <br />NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND <br />REDEVELOPMENT COMMISSION AS FOLLOWS: <br />1. The disposition actions taken for the Property are hereby affirmed and the staff <br />members of the Department are hereby authorized to dispose of the Property by way of private <br />negotiation, including the adjustment of the offering prices in the manner the staff considers <br />necessary to further the development plan, subject to the Commission's final approval of such <br />negotiations. <br />2. This Resolution shall be in full force and effect upon its adoption. <br />ADOPTED at a meeting of the South Bend Redevelopment Commission held on August <br />
