A RESOLUTION NO. 3073 ESTOPPEL RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION WHEREAS, the South Bend Redevelopment Commission (the "Commission "), the governing body of the South Bend, Indiana, Department of Redevelopment (the "Department ") and of the Redevelopment District of the City of South Bend, Indiana (the "Redevelopment District "), exists and operates under the provisions of IC 36 -7 -14, as amended from time to time (the "Act ") and is a body corporate and politic; and WHEREAS, the Commission has now acquired certain property more particularly described at Exhibit A (the "Property "); and WHEREAS, pursuant to and in accordance with IC 36- 7- 14 -22, the Commission has completed all acts necessary for the sale to the public of the Property to -wit: the Commission has caused two (2) separate appraisals to be made by independent appraisers; the Commission has prepared offering sheets for the Property to be offered and the offering prices, which were not less than the average of the two(2) appraisals; a notice of the offerings was published in accordance with IC 5 -3 -1; at the time fixed in the notice, the Commission stood ready to receive bids for the Property; no bids were received by the Commission for the Property; and more than thirty (30) days has elapsed since the time fixed in the notice for the opening of bids; and WHEREAS, the Commission now desires to affirm the disposition actions for the Property taken by the Commission and to authorize the Department, through its staff members to dispose of the Property by way of private negotiation, carried on by such staff members, including the adjustment of the offering prices in the manner the staff considers necessary to further the development plan, and subject to the Commission's final approval of such negotiations. NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT COMMISSION AS FOLLOWS: 1. The disposition actions taken for the Property are hereby affirmed and the staff members of the Department are hereby authorized to dispose of the Property by way of private negotiation, including the adjustment of the offering prices in the manner the staff considers necessary to further the development plan, subject to the Commission's final approval of such negotiations. 2.
