4 <br />RESOLUTION NO. <br />3095 <br />A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION <br />SETTING PROCEDURES FOR SUBMITTING APPLICATIONS FOR <br />PROPERTY TAX DEDUCTIONS (ABATEMENTS) <br />(2012) <br />WHEREAS, I.C. 6 -1.1- 12.1 -2(1) provides that a taxpayer's statement of benefits may not <br />be approved unless a resolution approving the statement of benefits is adopted by the Common <br />Council of the City of South Bend (the "'Common Council "); and <br />WHEREAS, I.C. 6- 1.1- 12.1 -2(1) previously provided that an application for a property <br />tax deduction required a resolution be approved by the South Bend Redevelopment Commission <br />(the "Commission ") prior to being considered by the Common Council; and <br />WHEREAS, the staff of the Department of Redevelopment will continue to prepare an <br />analysis and recommendation concerning each application for a property tax deduction under the <br />ILnew provisions in much the same manner as the staff did under the previous provisions; and <br />WHEREAS, the Commission wishes to remain informed as to the status of the various <br />applications for property tax deductions being presented to the Common Council so that the <br />Commission can adequately plan for the financial needs of various projects being considered by <br />the Commission on an annual basis; and <br />WHEREAS, the Commission has the authority under I.C. 36- 7- 14 -8(c) to adopt such <br />rules and by -laws as the Commissioners consider necessary for the proper conduct of their <br />proceedings and the carrying out of their duties. <br />NOW, THEREFORE, BE IT RESOLVED by the South Bend Redevelopment <br />Commission as follows: <br />1. The staff members of the South Bend Redevelopment Commission be and hereby <br />are directed to continue to prepare an analysis concerning each application for a <br />property tax deduction and to make a recommendation to the Common Council <br />regarding each such application. <br />2. All such analyses and recommendations shall be presented to the Commission in <br />summary form at the next regular meeting of the Commission following the <br />presentation of each recommendation to the Common Council. <br />3. This Resolution shall be in full force and effect after its adoption. <br />
