SUBSTITUTE BILL NO. 12-93 <br /> ORDINANCE NO. 3 5"8- P3 <br /> AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br /> INDIANA, AMENDING CHAPTER 20, ARTICLE 6 OF THE SOUTH BEND <br /> MUNICIPAL CODE BY THE ADDITION OF NEW SECTION 20-100.1 ENTITLED <br /> "PARKING PROHIBITED BY FIRE HYDRANTS" <br /> STATEMENT OF PURPOSE AND INTENT <br /> The Common Council recognizes that the regulation of parking of vehicles on City streets <br /> is a proper exercise of police power. More specifically Indiana Code § 9-21-1-3 authorizes <br /> local authorities to regulate the standing or parking of vehicles with respect to streets and <br /> highways under its jurisdiction. <br /> It has come to the Common Council's attention that there is an increasing number of <br /> individuals who park their motor vehicles by a fire hydrant thereby creating a public safety <br /> hazard. <br /> In the interest of promoting better public safety and insuring access to fire hydrants <br /> throughout the City at all times and especially in emergency situations, the following <br /> ordinance is introduced as an attempt to deter illegally parked vehicles by fire hydrants. <br /> �iobo, tfxrtfort, bt it rtssolioer bj tfx Common (outuiU of tfj¢ titj of 'ioutfh <br /> Vt10, Ittbiatta, as follows: <br /> Section I. The Common Council of the City of South Bend, Indiana, hereby amends <br /> Chapter 20, Article 6 of the South Bend Muncipal Code by the addition of new section 20- <br /> 100.1 which shall read in its entirety as follows: <br /> Sec. 20-100.1 Parking by Fire Hydrants Prohibited. <br /> (a)Any motor vehicle found parallel parked within fifteen (15) feet of a fire hydrant <br /> or in a designated fire hydrant no parking zone shall be fined fifty dollars ($50.00). <br /> Additionally, any motor vehicle found in violation of this Section may be towed at <br /> the owner's expense. <br /> (b) Appropriate signs giving notice of this parking prohibition shall be properly <br /> posted by the City. <br /> Section II. Chapter 2, Article 19, Section 2-213 entitled "Schedule of Ordinance and <br /> Violations" paragraph (a)of the South Bend Muncipal Code is hereby amended by adding <br /> the following provision numerically to such listing: <br /> Municipal Code Section Type of Violation Penalties <br /> Sec. 20-100.1 Parking Violation by Fire Hydrant $50.00 <br /> Section III.
