The Owner shall inspect the site during construction to ensure the Project Engineer's <br />conformance to area planning requirements, adequacy of design, and conformance to the City's <br />specifications and standards regarding location, size and depth of line, and quality of construction <br />of the Dedicated Improvements. The Owner shall provide the plans with a City of South Bend <br />cover sheet and specifications for the Dedicated Improvements along with a cost estimate to the <br />City. The Owner shall also provide to the City a statement from the Project Engineer certifying <br />that the materials and workmanship including pipes, bedding, thrust blocks, valves, fire hydrants, <br />and other related materials and work meet the City's specifications and standards. Upon request <br />of the City, the certification shall be substantiated by material affidavits from suppliers and by <br />applicable test results for inflow/infiltration, exfiltration, deflection, pressure, leaks, bacteria, <br />compaction and other tests required by the City. All construction, engineering and inspection cost <br />in connection with the Dedicated Improvements shall be borne by the Owner. <br />The Owner, either itself or through a Homeowner's Association established by Owner <br />("HOA"), will place funds each month into an escrow account that shall be used for the <br />maintenance and repair of sewer system, basins, and other privately owned infrastructure, in <br />accordance with the requirements set forth in Exhibit B. Each property owner not served by <br />separate gravity connection to the private sewer system will have individual grinder pumps/force <br />mains (owned by each property owner) that connect to the private sewer, with one gravity <br />connection to the public sewer system. At all times, the Owner, private owners, and the HOA (if <br />applicable) will have sole ownership and maintenance responsibilities for the private road, basins <br />(drainage), sanitary and storm sewer systems. <br />
