NEW BUSINESS (CONT.) <br />b. continued.... <br />project" as pulling the building permit. <br />The developer has explained to me that <br />they were under the understanding that <br />speculative tax abatement was not <br />available. In reviewing the circumstance <br />of this particular issue, I noted that the <br />developer first contacted our office in late <br />January of this year and inquired about <br />speculative tax abatement. They were <br />informed that speculative tax abatement <br />was not available but that the City Council <br />will probably be considering some kind of <br />change regarding this type of abatement in <br />the near future. The developer simply <br />assumed that their project was not eligible <br />and they began construction in mid - <br />February. Now that the City Council has <br />adopted some informal guidelines <br />concerning this type of abatement, the <br />developer wishes abatement to be <br />considered for their project. It does not <br />appear that the developer purposely <br />intended to circumvent any of our <br />procedural requirements, as they most <br />certainly could have pulled their building <br />permit at an even earlier date considering <br />the very mild winter weather. The <br />developer has stated that they were simply <br />under the impression that this type of <br />abatement was not available and was not <br />going to be available until sometime in the <br />spring or summer, but now that there is an <br />interest in granting these types of <br />abatements, the developer would like to be <br />considered. <br />-12- <br />
