purposes are more fully defined in the Articles of Incorporation and By-Laws of <br />said BCRC. <br /> <br /> <br />(B) Each Employer under this Agreement shall pay to BCRC the amount as <br />specified in Article XXXI of this Agreement per hour worked by each of its <br />Employees covered by this Agreement. Each Employer is obligated to make <br />such contributions, regardless of whether or not such Employer is a member of <br />BCRC. The Employer may submit funds electronically. <br />(C) Payments required to be made to BCRC shall be deemed to be governed by the <br />provisions of this Agreement pertaining to the collection of the Health and <br />Welfare and Pension payments required to be made by the Employer and thus, <br />may be enforced in the same manner. <br />(D) <br />books and records as they pertain to this contribution. It is further understood <br />that, in the event an Employer is determined to be delinquent and/or to have <br />failed to make contributions as required in this Article, any legal expenses of the <br />BCRC, including attorney fees, court costs and audit expenses, incurred in the <br />audit and collection of such delinquent and/or non-contributed funds shall be <br />borne by the Employer. It is further understood and agreed that such Employer <br />shall be obligated to pay any delinquent contributions to the BCRC with interest <br />charged at the rate of twelve percent (12%) per annum. <br />(E) The Employees covered by this Agreement will abide by the provisions of the <br />BCRC substance abuse program and policies. <br /> <br />(F) If, during the effective dates of this Agreement, there is an increase in the <br />required contributions to the Building and Construction Resource Center, Inc. <br />or the Construction Advancement Foundation, Inc., as determined by their <br />respective Board of Directors, the new contribution rate will be immediately <br />recognized and paid by the Employer as part of their usual obligations. If an <br />increase is necessary, notification must be received by the Indiana Laborers <br />stst <br />District Council on or before March 1 and will be effective June 1. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />40 <br /> <br />
