Provisions of this Sub-Contracting Clause shall be suspended for the following conditions <br />on a project: <br />1. A signatory contractor acting in the capacity of a CMc who is complying with <br />applicable legal public works and responsible bidder contract bidding and award <br />requirements required by House enrolled ACT 1196. Furthermore, the CMc shall <br />have no liability under this Article. <br />Section 2. This Agreement shall also apply to any work covered by this Agreement that <br />is performed by a joint venture in which the Employer has an ownership interest and the <br />Employer agrees on behalf of any such joint venture in which the Employer has an <br />ownership interest that the joint venture will comply with the requirements of this Article. <br /> <br />ARTICLE XXV <br /> <br />MANAGEMENT RIGHTS <br /> <br />Section 1. The Employer retains and shall exercise full and exclusive authority and <br />responsibility for the management of its operations, except as expressly limited by the <br />terms of this Agreement. <br /> <br />ARTICLE XXVI <br /> <br />UNIFORMITY <br />In the event that any other employer or employer group reaches an agreement with <br />the Laborers International Union of North America, State of Indiana District Council <br />covering in any part the same work as this Agreement, that is in the opinion of the <br />Association in any respect more favorable than a term of this Agreement, then said term <br />shall be a part of this Agreement as of the effective date of the more favorable provision. <br />The Laborers International Union of North America, State of Indiana District Council shall <br />notify the Association, by certified mail, return receipt requested, within seven (7) <br />calendar days of entering into any agreement with any other employer or employer group <br />covering any part of the same work as is covered by this Agreement, and shall provide the <br />Association with a copy of any other labor agreement now or hereafter negotiated with <br />anyone else covering in any part the same work as this Agreement but containing any <br />different terms or conditions. <br />Union of North America, State of Indiana District Council will notify by certified mail, <br />return receipt requested, and provide the name and address of any employer or employer <br />23 <br /> <br />
