(c) The Employer may call the Union for an individual by name, provided he is not <br />employed by another Employer. Under such circumstances the Union shall refer such <br />individual. <br />Section 2. Documentation and Verification The Employer and the Union will work <br />cooperatively to assure that both Parties comply with their legal responsibilities under the <br />Immigration and Reform and Control Act of 1986. In so doing, the Union will request <br />from each Employee before referring them to an Employer, documentation which <br />establishes citizenship or other legal status to work in the United States. These documents <br />shall be any of the documents which are allowed under the regulations promulgated under <br />IRCA. This section may be amended mutually when regulations are finalized on these <br />requirements. <br />Section 3. The Union will send no Employee to the Employer who they know does not <br />comply with the Residency Requirements of the Immigration and Reform Act. <br />ARTICLE VIII <br /> <br />WELFARE TRUST FUND <br /> <br />Section 1. On work covered by this Agreement, the Employer agrees to pay into the <br />Indiana Laborers Welfare Fund the amount in cents per hour as shown in Article XXXI. <br />Payment shall be made on the dates, in the manner, form and in accordance with the rules <br />and regulations as adopted by the Trustees of the herein mentioned Welfare Fund. The <br />Employer may submit funds electronically. <br />Section 2. The Employer agrees to be bound by the Agreement and Declaration of Trust, <br />entered into and dated May 25, 1953, establishing the Indiana State District Council of <br />Laborers and Hod Carriers Welfare Fund and Participating Employers and by any <br />amendments to said Trust Agreement. <br />Section 3. The Welfare Trust Fund shall be administered in accordance with all provisions <br />of applicable law. <br />ARTICLE IX <br /> <br />CONSTRUCTION WORKERS OF LAKE COUNTY <br />HEALTH REIMBURSEMENT ACCOUNT TRUST FUND, <br />LIUNA LOCALS #41 & #81 <br /> <br />Section 1. On work covered by this Agreement, the Employer agrees to pay into the <br />Construction Workers of Lake County Health Reimbursement Account Trust Fund the <br />amount in cents per hour as shown in Article XXXI.
