t <br />meeting and shall be acted upon at the next regular meeting or a special meeting called <br />within at least ten (10) days notice. <br />These By -Laws are set forth as amended August 18, 1986, December 18, <br />1995, December 19, 2005, April 16, 2008, October 20, 2008, January 26, <br />2009, and February 19, 2018. The 1986 Amendment enacted the new <br />Article 9, "Conflict of Interest", and the previous Article 9 "Amendments" <br />was re -designated as Article 10. The 1995 amendments added a new <br />Section 2 "Loss of Membership" to Article 2 and it added new Secretary <br />duties under Article 3, Section 5; it changed the requirement for a quorum <br />from 5 members to "a majority" under Article 4, Sections 3; it added the <br />Executive Director as a person who could call special meetings under <br />Article 4, Section 2; it added "Public Hearings -Certificate of <br />Appropriateness" as an agenda item under Article 6, Section 1; and it <br />changed the "Standards" Committee to "Standards and Maintenance" <br />Committee under Article 7, Section 1. The 2005 amendments changed the <br />title of Article 7 to "Committees and Advisory Board" from <br />"Committees"; expanded Section 1 "Standing Committees" to include <br />knowledgeable members from the citizens of South Bend and St. Joseph <br />County that are not appointed to the Commission and stipulates that all <br />members are appointed by the President and that the majority of Standing <br />Committee's membership must be from the Commission. It applied the <br />same to Section 2 "Special Committees" but stipulates that an opinion or <br />recommendation of a Special Committee is not binding on the <br />Commission. It also struck the phrase "which shall be named by the <br />Commission" and gives that authority to the President in Section 1. It also <br />struck the phrase "or by unanimous consent" in Section 2 concerning the <br />appointment of Special Committees. Section 3 "Advisory Board" was <br />added in its entirety. The April 16, 2008 amendment defined "Quorum" in <br />Article 4, Section 3. The October 20, 2008 amendment revised Section 6 <br />"Order of Business" to place Hearing of Visitors directly after Public <br />Hearing. The January 26, 2009 amendment adopted the NAPC Code of <br />Ethics and incorporated them into the By -Laws. The November 16, 2009 <br />amendment established Article 9.5 Staff Procedures. The February 19, <br />2018, amendment made various substantive changes to Articles 1, 2, 3, 4, <br />and 6, and deleted Articles 8, 9, and 9.5, due to the transition of <br />administrative responsibility for the Commission from St. Joseph County <br />to the City of South Bend and process improvements associated with the <br />transition. <br />1500.0000045 54906518.004 <br />11 <br />E <br />
