JOSEPH COUNTY <br />CITY OF SOUTH BEND <br />BUILDING DEPARTMENT <br />Re: Violations of City Ordinance at 1240 Thomas St, South Bend, IN 46625/Third Notice <br />Dear Mr. Boyd, <br />We recognize the effort to reduce violations of the City of South Bend Zoning Ordinance, at <br />your property located at 1240 THOMAS ST, SOUTH BEND, IN 46625, zoned "MU" Mixed <br />Use District. However, the property is still in violation. <br />The above -referenced property has the following violations: <br />1. The failure to obtain an improvement location permit when one is required by the terms <br />and provisions of this Ordinance, Section 21-1069(2), specifically doing construction <br />remodeling without application for applicable commercial building permits. <br />2. Failure to comply with any other provisions of this Ordinance, or other applicable <br />federal, state or local law or ordinance, Section 21-10(0(10), specifically the failure to <br />acquire a Certificate of Appropriateness for new construction from the Historic <br />Preservation Commission for a building identified as a South Bend Local Landmark, <br />(Ordinance No. 7591-86) <br />3. Failure to comply with the terms, provisions or conditions of any other permit required as <br />a prerequisite to the issuance of a improvement location permit, Section 21-1069(8)(C), <br />specifically the failure to comply with the Historic Preservation Commissions decision <br />against the work that has been recently done to the building. <br />VIOLATION REMEDY REQUIREMENTS <br />Immediately remove the additions to the building installed without issuance of a <br />Certificate of Appropriateness from the Historic Preservation Commission and <br />EXCELLENCE I ACCOUNTABILITY I INNOVATION I INCLUSION I EMPOWERMENT <br />125 S.
