JOSEPH COUNTY, INDIANA <br />President's Report for June 18th, 2017 <br />• 05/15/2017 7P: HPC Monthly Meeting (County -City Building; Room 1308). <br />• 05/22/2017 1:14P: Telephone conversation with Deputy Director Parcell <br />regarding enforcement procedures. <br />05/24/2017 8:30A: St. Joseph Superior Court (Room #7); Judge Hostetler <br />presiding. Observe hearing "Boyd vs. Historic Preservation Commission of South <br />Bend & St. Joseph County, et al." (Cause No. 71D07 -1703 -MI -000086). HPC <br />was represented by Deputy County Attorney — Brett Hummer. Mr. Hummer had <br />previously introduced a Motion to Dismiss based on a breech of the 30 day <br />limitation for proper filing (by Mr. Boyd). Defendants named in Mr. Boyd's case <br />were never presented with a summons despite the fact that the case was filed with <br />the court. Judge Hostettler ruled in favor of the Defendants agreeing that <br />dismissal was in order. He promised his formal,written decision within a few <br />days. Following the outcome, I met with staff members to discuss the court's <br />decision. <br />• 05/23/2017 6:20P: Discovered a suspicious depression in the brick street in front <br />of my house (617 Park Avenue), three feet north of the manhole cover. Reported <br />to the Department of Public Works and HPC staff, by copy. <br />• 05/25/2017: Received an email reply from Sue Ellen Doudrick, P.E. — Assistant <br />City Engineer who confirmed that an underground water main was leaking and <br />responsible for the new sink hole at Park Ave. South Bend Water Works was <br />directed to repair the issue. Work was completed later this same day. <br />05/29/2017: Draft and publish formal HPC response to counter public outrage <br />(NNN-Listserv) following recent Tribune article ( "Studebaker fountain might be <br />reborn Leeper Park" May 27, 2017) which suggested the installation of the <br />Studebaker Fountain in place of the duck pond. Communication became <br />necessary to counter misrepresentations that HPC had already reviewed such <br />proposal. Other members of the public had mistaken the flat work for the recently <br />approved labyrinth to be related to the fountain and duck pond removal. Response <br />was intended to clarify status and advise the public of procedural process. <br />Messages prompting my response are available upon request.
