- Molf"Zoe <br />DESIGN & BUILD OUTDOOR LIVING SPACE -- <br />Residential Service Agreement <br />THIS AGREEMENT made this 17 day of May, 2016, by and between Custom Outdoor Living, here in after called the <br />Contractor, Jim and Linda Laskowski here in after called the Owner. With this contract, the Contractor and the <br />Owner for the considerations, named agrees as follows: Front porch, steps and walkway. <br />SCOPE OF WORK <br />The Contractor shall furnish all of the materials and perform all of the work shown on the drawing and/or <br />described in the specifications entitled proposal A, as annexed hereto as it pertains to performed on property <br />located at: 1520 E. Wayne St. South Bend, IN. <br />GENERAL PROVISIONS <br />1. All work shall be completed in a workmanship like manner. <br />2. Contractor may at its discretion engage subcontractors to perform work, which warranties for one year <br />of all work that was contracted and performed by a subcontractor. <br />3. All change orders shall be in writing and signed both by Owner and Contractor. An additional fee based <br />on an hourly rate per change order will accrue upon Contractor discursion. <br />4. In the event Owner shall fail to pay any periodic or installment payment due hereunder, Contractor may <br />cease work without breach pending payment, resolution of any dispute, and may put a contractors lean <br />on the property of the owners house or commercial property until payment is received in full. <br />5. Contractor shall not be liable for any delay due to circumstances beyond its control including strikes, <br />casualty, weather, and general unavailability of materials. <br />6. Contractor warrants all installation workmanship for period of 1 year following completion. If contractor <br />is not hired to prepare complete application warranty is void. <br />7. Contractor is not liable for damage or defect of materials and causes by an act of god, damages beyond <br />our control, or subcontractors not contracted by contractor. <br />8. Contractor cannot guarantee that concrete, brick, sand work will not chip, crack, harden, discolor/haze, <br />match color, or salt damage. <br />9. Formal Notice of defects in writing to Custom Outdoor Living, 19766 County Rd.20, Goshen, IN. 46528, <br />must be given prior to expiration of 12 month completion date. <br />10. Contractor will be given access to roadways and driveways at and around job site, which also includes <br />verbal and or written permission to use neighbor access areas. Contractor will do his best to prevent <br />damage in these areas. Contractor will do his best not to disturb, damage, or destroy any trees, grass, <br />bushes, or plant material. However, if damage occurs, the contractor is not responsible. <br />11.
