- Molf"Zoe DESIGN & BUILD OUTDOOR LIVING SPACE -- Residential Service Agreement THIS AGREEMENT made this 17 day of May, 2016, by and between Custom Outdoor Living, here in after called the Contractor, Jim and Linda Laskowski here in after called the Owner. With this contract, the Contractor and the Owner for the considerations, named agrees as follows: Front porch, steps and walkway. SCOPE OF WORK The Contractor shall furnish all of the materials and perform all of the work shown on the drawing and/or described in the specifications entitled proposal A, as annexed hereto as it pertains to performed on property located at: 1520 E. Wayne St. South Bend, IN. GENERAL PROVISIONS 1. All work shall be completed in a workmanship like manner. 2. Contractor may at its discretion engage subcontractors to perform work, which warranties for one year of all work that was contracted and performed by a subcontractor. 3. All change orders shall be in writing and signed both by Owner and Contractor. An additional fee based on an hourly rate per change order will accrue upon Contractor discursion. 4. In the event Owner shall fail to pay any periodic or installment payment due hereunder, Contractor may cease work without breach pending payment, resolution of any dispute, and may put a contractors lean on the property of the owners house or commercial property until payment is received in full. 5. Contractor shall not be liable for any delay due to circumstances beyond its control including strikes, casualty, weather, and general unavailability of materials. 6. Contractor warrants all installation workmanship for period of 1 year following completion. If contractor is not hired to prepare complete application warranty is void. 7. Contractor is not liable for damage or defect of materials and causes by an act of god, damages beyond our control, or subcontractors not contracted by contractor. 8. Contractor cannot guarantee that concrete, brick, sand work will not chip, crack, harden, discolor/haze, match color, or salt damage. 9. Formal Notice of defects in writing to Custom Outdoor Living, 19766 County Rd.20, Goshen, IN. 46528, must be given prior to expiration of 12 month completion date. 10. Contractor will be given access to roadways and driveways at and around job site, which also includes verbal and or written permission to use neighbor access areas. Contractor will do his best to prevent damage in these areas. Contractor will do his best not to disturb, damage, or destroy any trees, grass, bushes, or plant material.
