In the latter circumstance, a Certificate of Appropriateness shall be required (HPC <br />Policy; adopted 12-16-91) <br />STAFF RECOMMENDATION: There is insufficient evidence to show that this structure, in its current condition, poses a threat <br />to public safety or that demolition is warranted. The building's condition and structural integrity appear sound. Staff recommends <br />continuous enforcement of the preservation guidelines and standards for the historic district under Zoning Ordinance of the City <br />of South Bend, ordinance No. 5565-73 and that the City use the legal means available to force the maintenance and/or repair of <br />any building or structure within the historic district in accordance with the intent of this ordinance. <br />Elicia Feasel, <br />Deputy Director <br />On a motion by Mike Voll with a second by Tom Gordon to deny application as presented. <br />Vote: 5 — 0 unanimous. <br />Mike Voll — I believe this house is structurally sound and viable and should remain standing for <br />the time being with hopes that a new owner would show up sometime soon. <br />Tom Gordon —I don't think that the house is to that point yet and some additional time should be <br />taken to try to move the house into someone that wants to repair and keep the house. <br />Tim Klusczinski — It seems that the house does not have the criteria listed to become a public <br />hazard at this point. I see a number of opportunities that Code Enforcement has failed in trying to <br />enforce the minimum maintenance standards for this particular house. I think it would be a <br />detriment to the Chapin Park Historic District and it would be a misuse of tax monies that could <br />be spent in other places. <br />Brandon Anderson — The rating on this building is contributing and I believe it still contributes to <br />this neighborhood and that it does have its architectural and structural integrity to continue to <br />contribute. I also agree with the chairman of our Commission that there needs to be further follow <br />up; we should not allow someone to dictate how we are running operations in the city, further we <br />should be able to go to them and say that these are the charges that are brought against this <br />property therefore you pay or you lose your property, not how can we support you take down <br />your house. I do believe in 1,000 houses in 1,000 days and what we are doing to move the City of <br />South Bend forward, however, I do not think that this is an appropriate example of that. <br />Elizabeth Hertel — It is vacant and has an owner that lives nearby. These gable walls are finished in <br />stucco/half timber effect. A one storey covered front porch which is also constructed in the split -faced block including the porch <br />knee -wall and piers which support Tuscan columns. <br />ALTERATIONS: COAs issued in 1998 indicate that replacement windows were approved for all windows, the rear porch was <br />enclosed and the steps restored to the east side of the porch; a new roof and gutter system was also approved.
