NO ORAL AGREEMENTS OR CHANGES: The Parties agree that no agreements, undertaking, or promises have been made or exist unless they are set forth in the Contract and that any prior discussions, agreements, promises or undertakings are superceded by this Contract. The parties also agree that no changes, additions, or deletions to this Contract may be made after the date of this Contract unless made in writing signed by all of the Parties to this Contract, except with respect to any change relating to a condition identified by us at the time of our verification of the work area in which we will install your order that requires additional work and/or materials to complete the installation of your order, as provided above. LIMITATION OF LIABILITY: In the event of any breach by us of this Contract, your exclusive remedy shall be to reject and return the goods, and receive a credit from us for all amounts paid thereon, if you are otherwise entitled to do so under this Contract. IN NO EVENT SHALL WE BE LIABLE FOR ANY OTHER DAMAGES, INCLUDING, BUT NOT LIMITED TO, INCONVENIENCE, TRAVEL TIME, INCIDENTAL DAMAGES, CONSEQUENTIAL DAMAGES, SPECIAL DAMAGES OF ANY KIND, PUNITIVE DAMAGES, LOST PROFITS, COSTS OF COVER, REPAIR, REPLACEMENT, OR ANY CONTINGENT LIABELI TIES WHATSOEVER We shall not under any circumstances be liable for any amounts in excess of the total cost of your order.
