That <br />ordinance was in effect when the building <br />permit was obtained from the City. She <br />also stated that to her understanding, the <br />building permit was obtained prior to the <br />ordinance later being found to be faulty, so <br />the developers were operating under an <br />ordinance that appeared to be valid at that <br />time. <br />Ms. Schwartz requested that a provision be <br />put in the Resolution that specifically states <br />that this is a unique circumstance. <br />Upon a motion by Mr. Faccenda, seconded <br />by Mr. Donoho and unanimously approved, <br />the Commission adopted Resolution No. <br />1538 approving an application for real <br />property tax deduction for property located <br />at 804 and 808 W.
