Local Landmark Designation Procedure <br />Historic Preservation Commission of South Bend & Saint Joseph County <br />1) A Local Landmark proposal can be initiated upon the request of. an owner, <br />representative, concerned citizen, concerned group, the Landmarks Committee of the <br />Historic Preservation Commission, or other governmental body. A proposal should <br />include the history of the potential landmark, notable architectural features, and/or other <br />related materials. <br />2) Upon receiving correspondence to pursue local landmark designation of a particular <br />building, structure, site, or object, the item is placed on the Historic Preservation <br />Commission's monthly meeting agenda under First Reading in Regular Business. At this <br />time, the matter is presented to the Commission and referred to the Landmarks <br />Committee. No major discussion takes place at this time. <br />3) The Landmarks Committee should set up a meeting as soon as possible to review the <br />proposed landmark(s) and to generate a report based on the following criteria: historic <br />and cultural value, educational value, and suitability for preservation. The report should <br />also include an unfavorable/favorable recommendation. <br />4) At the next available Historic Preservation Commission meeting, the report from the <br />Landmark Committee should be presented to the Commission under Regular Business. <br />No decision should be made at this time. Proposed landmarks not meeting the rating <br />criteria (11 or greater) should be re-evaluated by the Landmarks Committee prior to the <br />public hearing. Any change to the rating shall be voted upon by, the HPC. <br />5) A public hearing (Second Reading), should be scheduled at the next available meeting <br />after the report from the Landmark. Committee. The second reading should be listed <br />under Public Hearing. Ample notification will be given to. the property owners and other <br />organizations that would wish to comment regarding this item. During the Public <br />Hearing, the Commission would receive comments from proponents and opponents and <br />make a recommendation to the appropriate council. <br />The proposed ordinance with the proper legal description should be prepared before the <br />Commission's second reading. The proposed ordinance with a cover letter will be sent to <br />the appropriate council. It will then follow the path through the council's readings and <br />public hearings. If designated, the ordinance for the landmark will be filed with the <br />City/County Clerk or the County Recorder, and in the HPC's offices.
