First, it will <br />provide an area for the dog to run. This area is enclosed by 42 -inch tall, by 8 -foot panels <br />of French Gothic Pickets. Two gates, one located at the west side of the house one foot <br />forward from the rear of the house. The second gate is two feet west of the rear cast <br />corner of the house. This fence begins where the stockade privacy fence ends and <br />continues north approximately 24 -feet, set 6 -inches east of the west property line, then <br />turns east for approximately 6 -feet, where it meets the house. This 6 -foot section is the <br />only section of the fence visible from the street. On the eastern side of the enclosure, the <br />fence line runs north and outlines a parking area for the Grand Marquis automobile which <br />is one foot longer than the garage., making it unable to fit into the enclosed garage. <br />The second area is intended as an entertainment and relaxation area with a 12 by <br />12 -foot one foot square tile surface set on a gravel and sand base at ground level. In the <br />center of this patio area is an in ground 27 -inch circular fire ring with barbeque grill <br />cover.. rising 18 -inches from below the surface of the patio and enclosed with RiverToNNn-- <br />retaining wall stones. This area is enclosed by 6 -foot tall by 8 -foot long stockade panels. <br />— A single gate is located on the north side of the enclosure and faces the rear of the house. <br />This fence sets one foot north of the north side of the alleyway and is shielded on the <br />north side by 8 -foot tall Lilac bushes. The fence then runs north along the west side of <br />Lot 35, and is set 6 -inches east of the western property line. A Burning Bush hedge of <br />over 8 -feet in height owned by the owner of Lot 34, shields this fence from that neighbor. <br />The privacy fence ends approximately one half the distance of this hedge,xvhcre the <br />picket fence then begins and runs approximately 24 -feet north of the end of this hedge. <br />A photograph, circa 1965, of the former Mr. Melander, of 1064 Wood,,Nrard <br />Avenue, sets directly across the alleyway from the rear of Lot 35, which is 1081 <br />Riverside Drive. This fence has not existed for over forty years. The privacy fence <br />replaces the pictured picket fence. <br />The owner of 1081 Riverside Drive began construction of the rear of the privacy <br />fence under the impression that no permits, including a CoA was necessary since the <br />fence project was in the rear yard and not visible from the street. Nklien the owner <br />became aware that their assumptions were incorrect, they halted all construction until <br />permits could be obtained. There was no malice of forethought. <br />
