NEW BUSINESS (CONT.) <br />m. continued.... <br />for a tax abatement and getting individual <br />approval from the City of South Bend <br />Common Council, the Council determined <br />that they would declare this particular area <br />eligible for tax abatement, and the home <br />owners would automatically receive the <br />tax abatement. <br />Mike Beitzinger stated that South Bend <br />Heritage Foundation learned of the new <br />ordinance and they began the process for <br />the construction of the two homes located <br />at 804 and 808 W. LaSalle with the <br />understanding that the abatement for the <br />two homes would automatically be applied <br />to the sale of these properties. The City <br />subsequently reviewed the ordinance <br />found it not completely in compliance <br />with state requirements concerning <br />residential tax abatement, so the Council <br />then repealed the ordinance and passed a <br />revised ordinance that again incorporated <br />the area. However, the revised ordinance <br />still required the owners of the properties <br />to come forward individually and petition <br />for the tax abatement. <br />Mike Beitzinger stated that this wasn't <br />brought to South Bend Heritage <br />Foundation's attention until early this <br />year. <br />Mike Beitzinger stated that state law <br />allows the City of South Bend to waive the <br />requirement that the abatement be <br />approved prior to the start of construction. <br />H:\ HOME\ CPHIPPS \WPDATA \COMMSN\081597.MIN -12- <br />
