1. Correspondence -File Circulated. Catherine noted Lunch & Learn series, <br />renewal of National Trust membership, Simeri samples of tree bark, St. Paul <br />Sanctuary Gourmet Garden. <br />2. Routine Maintenance Exclusion Approvals - Submitted in packets. <br />3. Director's Report - Distributed. Linda Riley questioned if East Wayne tree <br />trimming notifications had already been sent out to homeowners. Catherine noted <br />that they had. <br />4. AD Report - Distributed. Elicia reported on the NAPC Forum, <br />specifically about considering an update to the guidelines regarding solar panels, <br />green roofs, etc. Tim discussed with Larry the possibility of coming up with an <br />approach to recommendation that the commission could use when considering <br />these types of applications before amending the guidebooks. <br />5. Legal Counsel -Larry brought up the issue of replacement features <br />installed before property was landmarked and the distinction between when the <br />property was landmarked and if the homeowner illegally replaced after subject to <br />guidelines and COA process by either ignoring guidelines or doing the work after <br />the application was denied. Existing owners, regardless of who did it could be <br />ordered to correct the violation because they bought the property subject to the <br />violation, which can be discovered upon inspection of public record. There are <br />cases that support an injunction or a cease and desist order when the historic <br />preservation ordinance is violated and there is no time limit in voicing that. If <br />replacement was prior to the institution of the historic district than probably <br />cannot demand that it be brought back to historic standard. Discussion of time <br />limits. Larry will summarize this opinion and submit to commission. <br />D. COMMITTEE REPORTS <br />1. Presidents Report -Tim reported that he attended the Energy Audit at CPI <br />612 Portage Avenue with compliments to Elicia and Jennifer for planning the <br />workshop. Tim attended Lead Based Paint RRP Overview of Final Rule by the <br />EPA. <br />V. OLD BUSINESS <br />A. Wrap up on Energy Audit — Elicia reported that Ron Zymslo offered to do an <br />energy audit on an occupied house as a follow up to the equipment failure during the <br />Energy Audit Workshop and suggested that HPC and Indiana Landmarks could raffle <br />tickets to raise money. Further discussion with Legal council will be needed regarding <br />raffle. Discussion of www.RestoreMichiana.com. <br />B. Spigelmyer window restoration production — Elicia provided an update on project. <br />VI. NEW BUSINESS <br />A. State Theatre — Elicia reported on the HPF grants and Opera Lasalle's project. <br />Elicia asked that the commission consider sponsoring the HPF grant for the State <br />Theatre's Opera Lasalle non - profit, written by Indiana Landmarks. The grant <br />will be less competitive due to the fact that 10% of HPF funds are required to be <br />allocated to CLG's. <br />On a motion by Tim Klusczinski to sponsor the motion in the language that Elicia <br />provided us with a second by Linda Riley. <br />Vote: 4 -0 <br />Motion carries with a unanimous vote. <br />Legal counsel concurred that there are no liability issues for the HPC to sponsor this <br />grant. <br />6 <br />
