The <br />foregoing documents, together with any other documents specifically identified in the paragraphs <br />below shall be referred to collectively as the contract documents, and shall constitute the entire <br />agreement between the parties. <br />Assurance of Financing: Buyer represents and warrants to contractor that it now has or will <br />have within thirty (30) days from the date of this contract cash on hand, or a firm commitment <br />for a mortgage loan, in an amount sufficient to pay the entire purchase price and all of buyer's <br />other obligations under this contract, and that it will furnish written evidence thereof to the <br />contractor. In the absence of such written evidence, contractor shall have a discretion to delay <br />construction or cancel this contract and refund the down payment. - Buyer hereby authorizes it's <br />mortgage lender to make payments directly to contractor. <br />Payment of Purchase Price: Buyer agrees to pay contractor the balance of the purchase price <br />and all other monies due under this contract under substantial completion of the work. The <br />making of final payment by buyer shall constitute a waiver of all claims by buyer against <br />contractor, except only those arising from unsettled liens, or agreed punch list items. <br />Changes: Changes in the contract documents are to be made only by written change orders, <br />signed by buyer and approved by contractor. The cost of any changes shall be added to or <br />subtracted from the purchase price as appropriate. <br />Allowances: Dollar amounts designated as allowances are understood to be the contractor's <br />estimate of the cost of the items indicated. If the contractor's actual cost exceeds the <br />allowance, the amount of the excess shall be added to the purchase price. If the contractor's <br />actual cost is less than the allowance, the difference shall be deducted from the purchase price. <br />Exclusive Warranty: Contractor warrants all materials and workmanship for a period of (1) year <br />from the date of closing. Contractor's obligation shall be limited to repair or replacement, in <br />contractor's discretion, of the defect or complaint. This is the sole and exclusive warranty given <br />by the contractor. <br />Permits: Contractor will furnish any applicable building permits and health permits. <br />Insurance: Contractor will provide Builder's Liability Insurance, Builder's Risk Insurance, and <br />Workman's Compensation Insurance for it's employees, and any other insurance required by <br />law. <br />
