Patrick. I'd like to make one comment regarding the letter. I am sympathetic to problems
with the skewed property tax system and the cost of maintaining a house, but this is a
local landmark rated outstanding and many of the items, while she makes some good
points, really aren't germane to this project and I am sympathetic to it, but that does not
impact on the historic appearance of this house. These are extenuating circumstances
that are going on throughout South Bend, Indiana and the whole world. I'm not
comfortable with this project, covering up this house like that.
Klusczinski: Thank you, any other thoughts?
Chase: I feel that so much is unclear. Very little is definitely said. You can't paint the
house, but you'll paint the trim, well that trim and posts will have to be periodically
repainted anyway and without a certificate on the lead where they think that it's on some
places but not on others and decisions would have to be made as situations arose, there's
just too much not clear.
Klusczinski: I agree.
Chase: The house looks in good condition.
Ujdak: My opinion is that since this has an outstanding rating that it deserves perhaps
more than just average treatment. I think what needs to be done is to do as much as
possible to keep it in it's originality. It's rated outstanding, were it something else, much
lower, then it would be a different story perhaps.
Klusczinski: Chair opens public hearing, is there any member of the public wishing to
speak in support of the current petition? Hearing none, is there any member of the
public wishing to speak in opposition?
Dietz: I have a question. How long has this person owned the house?
Klusczinski: Wait, if you're going to make a public comment are you going to be
speaking in support or opposition to the petition? And then we'll need your name and
address too.
Dietz: Oh, I'm sorry, I would be in opposition.
Klusczinski: We're open for opposition comments right now if you'd like to make one.
Dietz: Sure, I'm Don Dietz, 1031 E Jefferson and I do also own a historic landmark
house where the paint is failing and with the understanding that when you buy these
properties it is brought to your attention that it does need to be maintained according to
a standard. Just because it's a longer process to repaint it and it may cost more in the
long term to do so, it's part of the responsibility that you assume when you do buy these
properties. So just be able to change it for your convenience, I don't agree with.
Klusczinski: Thank you very much sir, any other comments? Chair closes public hearing.
I'll entertain a motion.
Chase: I'd like to make a comment first. In the letter, it says and I'll quote, V bought the
house because I love old historical craftsmanship, the beauty of the home and because
I'm committed to the neighborhood and area'. Seems contradictory to what's being
asked.
Patrick. Good point.
Klusczinski: Chair will entertain a motion.
Patrick: I'll move. Does anyone else want to? For application number 2008-0521, be
declined, is that the correct word?
Klusczinski: Denied.
Patrick: Be denied. Do I have to state the specific reasons?
Klusczinski: When we take roll call.
Sassano: Each of us has to.
Klusczinski: If it's in accordance with the motion to deny, then we'll have to state a
reason against this C of A. Motion has been made, is there a second?
Ujdak: Second.
Klusczinski: Motion has-been made and seconded, any additional discussion? Hearing
none, I call for a roll call.
