to speak in support? Hearing none. Any member of the public wishing to speak in opposition? Hearing
none. Sir, if you could please state you name and address:
Goodling: Wayne Goodling, 1201 W Washington Street, South Bend. I have a question. In all of this
discussion, we're looking at fiber optics, which I assume had to travel for miles to get to this location,
why isn't more discussion given to moving it to the rear of the property? That's my question.
Riley: We did discuss this with the LaPierre's. There are bushes right east of the sidewalk and it would
make an ideal place for the boxes, but they objected thinking that it would be a problem for the next
owners. And you can't force them to accept it.
Sporleder: So what you're saying is that if it went to the alley it would be on the LaPierre's property?
Riley: If there were a real alley.
Wright: There are utility easements (unintelligible)
Klusczinski: Any others in opposition?
Sporleder: Can I clary...
Klusczinski: I'd like to close the public hearing first then we can go into discussion. Ok, we've closed
the public hearing.
Sporleder: I'm not totally understanding..I think that the suggestion follows along with the original in
putting in the ... I guess my question sort of is is there anything else in the box besides the fiber optics, and
who owns... is there an alley, and who owns the alley?
Riley: There is no alley.
Sporleder: So in other words, if it goes in the rear, it goes on private property? So that clarifies that.
Chase: She said there's a utility easement.
Sporleder: There's a utility easement but not an alley. In order to service it, they'd have to go on private
property and all that.
Klusczinski: Is there anything else that you'd like to rebut from the public hearing?
Wright: No, sir.
Klusczinski: Ok.
Sporleder: Don't go away, I want to ask you another question.
Wright: Ok.
Klusczinski: The Chair would entertain any other Commission discussion. At this point, hearing none, I
would entertain a motion. We've voted to amend the C ofA but we haven't voted to accept it.
Patrick: Can I move to accept the C ofA as amended?
Riley: Second.
Klusczinski: All in favor? (Ayes are heard) Opposed? (Silence) The motion carries.
Moved: Patrick
To Amend C of A 2007-0430A
Moved: Patrick
To Approve C of A 2007-0430A
Second: Riley
Approved Unanimously
Second: Riley
Approved Unanimously
B.
