John Peddycord: Yes, we are in the process, assuming that HLFI does submit a written request. I've
<br />been assured by the officials that we've been working with, and they're out of Toronto, Ontario, they
<br />will seriously evaluate any such a proposal and all the pros and cons and it will take us some time to .
<br />do that even if he submitted it tomorrow. I assume that Mr. Zeiger has to go through the proper
<br />channels in his organization, too, to get that request, but we are open to that, or South Bend Heritage
<br />Foundation, or anybody else, other non -profits, that might have an interest in it, or private parties as
<br />far as that goes. Just that, and we've encouraged, I will say we've encouraged the officials to come
<br />down and look at the property, and they have, well at least one. I think it's somewhat, even though its
<br />_ on the comer_of the roe I think historical) its deemed apart of the cemetery and obviously rt

<br />was intended to be apart of the cemetery. That's my personal bent. I think maybe there would be
<br />some nominal incidental value to the property owner to have it maintained, or if somebody has the,
<br />money with which to do it. They see no reason to do that and have no purpose for the building...
<br />They have much more land vacant in the Highland Cemetery across the street and that's where
<br />they've moved their administrative offices to years ago. I think they've said they haven't used it for
<br />eight or nine years, if I remember right.
<br />Shawn Peterson: So, you're still exploring those options?
<br />John Peddycord: We'll still explore those, but we want to go on parallel tracks, if you don't mind my
<br />use of that term.
<br />Shawn Peterson: Have you explored moving the premises? I know that was mentioned by the
<br />appraisers.
<br />John Peddycord: Other than what Mr. Huddleston has talked about, Todd did inform me, and again
<br />I'm not trying to put him on the spot, but he asked me to make sure the appraisers saw the basement
<br />and I understood why he did that because having done a lot of real estate litigation, he wanted me to
<br />make sure they knew the basement was dry. There are no water problems in that basement, so he
<br />mentioned to me that because of the type of structure that it might be difficult with the type of
<br />basement it has to move the residence. Now, I don't know if he's bothered, I doubt if you've
<br />interviewed any or obtained any estimates from any movers, or to even determine whether it can be
<br />moved. I don't know.
<br />Shawn Peterson: Have you officially put it on the market?
<br />John Peddycord: No, we have not.
<br />Shawn Peterson: At this time I will, first of all, it was mentioned to the standards applicable here and
<br />let me read it for you, the standards, and then we'll open it to testimony from the public on this. And
<br />for the record, Todd Zeiger has agreed to abstain from this since he has been in conversation
<br />regarding purchasing, so to avoid any conflicts, he will abstain from the vote and immediately
<br />preceding discussions or deliberations although he could have the opportunity to ask questions as a
<br />Commissioner and speak during the public portion of it. The standards applicable to this landmark
<br />are the standard, of what is called the `B Standard" as we refer to them, and whether the A Standards
<br />or the B Standards are applicable is actually, is not so much of consequence as they are the same and I
<br />will read them. "Historic landmarks shall not be demolished. When a landmark poses a threat to the
<br />public safety and demolition is the only alternative, documentation by way of photographs, measured
<br />drawings, or other descriptive measures should be made of both the exterior and the interior of the
<br />Landmark. The person or the agency responsible for the demolition of the Landmark will be
<br />responsible for this documentation."
