B. Vote on Amendment to By -Laws: Resolution 05-01 <br />Joann Sporleder: Under Section III, vis-a-vis what our counsel has just been telling us about Open Door <br />things, it would seem to me that the last paragraph would need to instruct the Advisory Board with it must <br />adhere to the Open Door Law as part of what they are required to do. [Quoted section of the amendment.] <br />I think there should be some notice in this that the advisory board should it be created needs to be aware <br />of the Open Door Law and their meetings must also be made public. <br />Lynn Patrick: I'd like to ask our counsel that since the Advisory Board does not make a rule and no <br />opinion or recommendation is binding in any way, do they need to adhere to the Open Door Law? <br />Shawn Peterson: If you delegate official action. The question is: are you doing that? Shawn provided <br />the Commission with a few options for the Advisory Board. It could publicly notice the meetings or they <br />could be research/fact-finding missions with the information then presented to the Commission in a <br />public hearing as testimony that would not have the weight of a recommendation. Other members of the <br />public would also be allowed to testify. <br />Todd Zeiger: We have the option of deciding whether or not it will have the full weight of a <br />recommendation or not. I'm not sure we need to delay this for another month. <br />Martha Choitz: I move that we use substitute resolution 05-01 as our guide in establishing an Advisory <br />Board. Catherine Hostetler seconded the motion and it passed 6-1; Joann Sporleder was opposed. The <br />Commission members then signed the resolution. <br />C. Michigan Street Bridge: additional CoA extension <br />Todd Zeiger moved to provide an extension to the CoA for the Michigan Street Bridge until November <br />2007. Joann seconded the motion and it passed unanimously. <br />IV. NEW BUSINESS <br />No additional items were heard. <br />V. HEARING OF VISITORS <br />Don Sporleder wished the Commission a very Merry Christmas. <br />VI. ADJOURNMENT: Lynn Patrick adjourned the meeting at 9:05 pm <br />
