INDIANA 46601 <br />Catherine Hostetler <br />Commissioner <br />South Bend and St. Joseph County <br />Historic Preservation Commission <br />227 West Jefferson Blvd. <br />South Bend, Indiana 46601 -1830 <br />SUBJ: SALVAGE RIGHTS, LINCOLN PRIMARY CENTER <br />Dear Ms. Hostetler: <br />This letter is .in response to your query of January 20, 2006 regarding salvage rights to the <br />Lincoln Primary Center (LINCOLN). <br />The bid package for the demolition of LINCOLN has been written and is now out for bid. As <br />written in the demolition specification package, the contractor who is ultimately awarded the <br />demolition contract, will retain salvage rights to any material that remains in the building. By <br />writing the demolition bid specification in this manner, I am of the opinion that the South Bend <br />Community School Corporation will capture the value of material left behind in the building. The <br />winning contractor will be able to adjust their bid, as appropriate, for any items of value which <br />they desire to salvage from the building. <br />In your correspondence, you proposed that I assign the salvage rights of LINCOLN to the <br />Historic Landmarks Foundation of Indiana. Based on my understanding of the State of Indiana <br />procurement and disposal regulations, it is not within my authority to make such a decision or <br />take such action. <br />Due to school scheduling constraints, demolition will occur at an accelerated pace and the <br />contractor selected for demolition will be required to make scheduling commitments. If the <br />material at LINCOLN continues to be of interest to you and the Historic Preservation <br />Commission, I recommend that you negotiate any terms with the demolition contractor.
