567 Vl. Enforcement Procedures (p.27) <br />568 Enforcement of the preservation guidelines and standards for the <br />569 district is made possible in the Zoning Ordinance of South Bend, <br />570 Ordinance No. 5565-73. <br />571 The Historic Preservation Commission may petition the Building <br />572 Commissioner to use the legal means available to him/her to force the <br />573 maintenance and/or repair of any building or structure within the historic <br />574 district in accordance with the intent of this ordinance. <br />575 This ordinance however, does not prevent the ordinary maintenance and <br />576 repair of any building or structure which does not involve a change in any <br />577 exterior feature, nor does it prevent the reconstruction, alteration, <br />578 demolition or moving of any building or structure which the Building <br />579 Commissioner or other official has determined to be a hazard to public <br />580 safety. <br />581 Property owners wishing to do, or have done, any work affecting the <br />582 exterior of their building or land must apply directly to the Historic <br />583 Preservation Commission on the form prescribed by the Commission <br />584 (see Appendix A). The Historic Preservation Commission shall issue <br />585 a Certificate of Appropriateness before commencement of any <br />586 construction, reconstruction, alteration, demolition or moving of any <br />587 house or structure within the historic district boundaries (see <br />588 Appendix A). <br />589 The Historic Preservation Commission will accept applications for <br />590 Certificate of Appropriateness only from the property owner. In making <br />591 its determination, the Historic Preservation Commission shall consider <br />592 three factors: <br />593 First, the appropriateness of the proposed work to the preservation of the building and district; <br />594 Second, the detriment to the public welfare if the proposed work is permitted even though it is <br />595 not deemed appropriate; <br />596 Third, the potential hardship that the denial of the Certificate of Appropriateness would cause <br />597 the applicant. <br />598 Where the Commission deems it necessary, the Commission may <br />599 petition the Common Council for a temporary delay in the issuance of <br />i 600 the required permit(s) for proposed construction, reconstruction, <br />23 <br />
