COMMISSION ASSISTANCE m <br />PROGRAM LAN� HISIDRIC <br />AGREEMENT FOR PROFESSIONAL I I FOUNDOSNOF <br />INDIANA <br />SERVICES J1P1 <br />This agreement entered into this first day of by and between the <br />South Bend/St. Joseph County Historic Preservation Commission, City of South Bend, County of St. <br />Joseph, State of Indiana, hereinafter referred to as the "Local Public Agency," and Historic Landmarks <br />Foundation of Indiana, hereinafter referred to as the "Contractor." <br />WITNESSETH: <br />WHEREAS, the Local Public Agency desires to promote certain historic preservation activities <br />within the County of St. Joseph/City of South Bend, Indiana; and <br />WHEREAS, the Local Public Agency desires the services of a qualified preservation <br />professional, to serve as a part-time consultant to its Historic Preservation Commission (hereinafter <br />referred to as'The Commission") and staff; and <br />WHEREAS, the Contractor represents that it is qualified to render such services to the Local <br />Public Agency, and is a qualified professional as defined 36 CFR 61 authorized by the National <br />Historic Preservation Act of 1966 as amended (P.L. 89-665) and the National Historic Preservation <br />Amendments Act of 1980 (P.L. 96-515); as defined in the Scope of Services below: <br />NOW THEREFORE, the parties hereto do mutually agree as follows: <br />1. SCOPE OF SERVICES. The Contractor shall coordinate the work of a qualified <br />preservation professional, or "community preservation specialist," who shall perform <br />the following services: <br />a) Provide consultation on Certificates of Appropriateness. <br />b) Provide technical assistance to historic property owners throughout the community. <br />c) Attend meetings of the Commission when requested by the Commission Chairperson. <br />d) Assist in the promotion of historic preservation generally within the City. <br />e) Provide additi6nal technical assistance in such areas as National Register review, <br />local landmark nominations and tax act projects. <br />f) Assist with Section 106 Environmental Review within the City. <br />g) Conduct two training workshops for the Commission members and staff. <br />h) Plan and coordinate two property owner and/or contractor training workshops per <br />year. These could be in concert with other local groups or Commissions. <br />2. RESPONSIBILITIES OF THE LOCAL PUBLIC AGENCY. The Local Public Agency and the <br />Historic Preservation Commission will adopt an annual work program of projects which will <br />assist in preservation planning activities for the period of one year. The work program will <br />identify projects & training needs for the year. <br />3. TIME OF PERFORMANCE: The services of the Contractor shall commence <br />January 1, 2005 and shall be completed December 31, 2005. <br />
