COMMISSION ASSISTANCE m PROGRAM LAN� HISIDRIC AGREEMENT FOR PROFESSIONAL I I FOUNDOSNOF INDIANA SERVICES J1P1 This agreement entered into this first day of by and between the South Bend/St. Joseph County Historic Preservation Commission, City of South Bend, County of St. Joseph, State of Indiana, hereinafter referred to as the "Local Public Agency," and Historic Landmarks Foundation of Indiana, hereinafter referred to as the "Contractor." WITNESSETH: WHEREAS, the Local Public Agency desires to promote certain historic preservation activities within the County of St. Joseph/City of South Bend, Indiana; and WHEREAS, the Local Public Agency desires the services of a qualified preservation professional, to serve as a part-time consultant to its Historic Preservation Commission (hereinafter referred to as'The Commission") and staff; and WHEREAS, the Contractor represents that it is qualified to render such services to the Local Public Agency, and is a qualified professional as defined 36 CFR 61 authorized by the National Historic Preservation Act of 1966 as amended (P.L. 89-665) and the National Historic Preservation Amendments Act of 1980 (P.L. 96-515); as defined in the Scope of Services below: NOW THEREFORE, the parties hereto do mutually agree as follows: 1. SCOPE OF SERVICES. The Contractor shall coordinate the work of a qualified preservation professional, or "community preservation specialist," who shall perform the following services: a) Provide consultation on Certificates of Appropriateness. b) Provide technical assistance to historic property owners throughout the community. c) Attend meetings of the Commission when requested by the Commission Chairperson. d) Assist in the promotion of historic preservation generally within the City. e) Provide additi6nal technical assistance in such areas as National Register review, local landmark nominations and tax act projects. f) Assist with Section 106 Environmental Review within the City. g) Conduct two training workshops for the Commission members and staff. h) Plan and coordinate two property owner and/or contractor training workshops per year. These could be in concert with other local groups or Commissions. 2. RESPONSIBILITIES OF THE LOCAL PUBLIC AGENCY. The Local Public Agency and the Historic Preservation Commission will adopt an annual work program of projects which will assist in preservation planning activities for the period of one year. The work program will identify projects & training needs for the year. 3. TIME OF PERFORMANCE: The services of the Contractor shall commence January 1, 2005 and shall be completed December 31, 2005.
