Chapin Park Historic District constructed from 1890 to 1909, as many, <br />including the Queen Anne Inn, had such terra cotta capitals. <br />8. That Scamozzi capitals were popular in the Chapin Park Historic District <br />and the near westside of South Bend and their loss would prevent the <br />preservation of a historically significant brand of architecture of that era. <br />9. The substantial architectural significance of the Scamozzi capitals at the <br />Historic Premises and in the Chapin Park Historic District is a factor that <br />weighs against the proposed Alterations. <br />10. Based on the evidence presented, the replacement Doris capitals are not an <br />appropriate replacement for the Scamozzi capitals for this Free Classic <br />Queen Anne style house in the Chapin Park Historic District. <br />11. Replacement Scamozzi capitals are available and may. be used in a manner <br />that does not cause undue hardship to the Petitioners, as evidenced by the <br />staff's testimony and the Petitioner's previous replacement of a damaged <br />Scamozzi capital in 2001. <br />12. , There is no substantial public benefit weighing in favor of allowing the <br />Alterations, despite their inappropriateness. <br />The Certificate of Appropriateness No. 2005-1104A is,l�iereby DENIED. <br />klistoric Preservation Commission of <br />South Bend & St. Joseph County. <br />Attest <br />Because the Alterations may be removed and replaced with Scamozzi capitals in <br />the future without harming the Historic Premises and ' because of the special <br />circumstances of the Petitioner, in particular the economic hardship that may result from <br />removing the Alterations and installing the proper Scamozzis, the Commission hereby <br />covenants and agrees not to prosecute this violation of the District's standards, contingent <br />upon the following circumstances: (i) the Petitioners from this point forward seek <br />certificates of appropriateness prior to the commencement of any work for which a <br />certificate of appropriateness is required; (ii) the Petitioners faithfully abide by the rules <br />and regulations of the District; and (iii) the Petitioners forever waive their right to appeal <br />the above denial.
