structure will be constructed with a 42 degree 15'22" right skew to US 20. Along Locust Road, there will be two <br />12' lanes with 11' usable and 10' paved shoulders (12' paved adjacent to guardrail). The minimum right of way <br />width will be 40' (existing) and the maximum will be 250'. The amount of permanent right of way to be acquired <br />for the proposed project is 1.6 acres. Approximately 0.16 acres of temporary right of way will be needed for drive <br />construction. Survey limits along Locust Road will extend from 1000' north to 1150' south of the existing <br />structure, along the existing roadway centerline. Along US 20, the survey limits will extend from 675' west to 675' <br />east of the existing structure. Traffic on Locust Road will be maintained by using a detour that utilizes local roads. <br />The detour route will follow Ireland Road, Linden Road and Ewing Avenue. Traffic on US 20 will be maintained <br />by using at a minimum one lane of traffic in each direction. <br />Per FHWA's request, we are seeking input from historical consulting parties prior to establishing a final <br />determination of effect. The St. Joseph County Interim Report of the Indiana Historic Sites and Structures Inventory <br />was referenced and within the proposed project area, there are no sites either listed on, considered eligible for, or <br />being considered for eligibility on the National Register of Historic places. Furthermore, the structure is not listed in <br />Dr. Cooper's Artistry and Ingenuity in Artificial Stone, Indiana's Concrete Bridges, 1900 -1942. At this time, <br />INDOT has determined that there will be no historic properties affected. The recommended APE includes the <br />proposed right-of-way and the area immediately surrounding it. This correspondence is being forwarded to the <br />following historical consulting parties for confirmation of the above determination: State Historic Preservation <br />Officer (SHPO), Historic Landmarks Foundation of Indiana, St. Joseph County Historian, South Bend Heritage <br />Foundation, Inc., Downtown South Bend, Inc., and Historic Preservation Commission of South Bend and St. Joseph <br />County. Archaeology will be performed and forwarded to SHPO for concurrence. <br />Section 106 of the National Historic Preservation Act requires Federal agencies to take into account the effects of <br />their undertakings on historic properties. In accordance with 36CFR800.2(c), you are hereby requested to be a <br />consulting party to participate in efforts to identify historic properties potentially affected by the undertaking, assess <br />its effects and seek ways to avoid, minimize or mitigate any adverse effects on historic properties. Per <br />36CFR800.3(f), we hereby request that the State Historic Preservation Officer (SHPO) notify this office, within 30 <br />days of the receipt of this letter, under separate cover, if the SHPO is aware of other parties that may be entitled <br />to be consulting parties for the subject project. <br />Please respond with your comments on any environmental impacts associated with this project. If we do not receive <br />a response within, sixty days, it will be assumed that your agency feels that there will be no adverse effects incurred <br />as a result of the proposed project. Should you find that an extension to the response time is necessary, a reasonable <br />amount will be granted upon request.
