The extent was shown on the plans and a special provision was included in <br />the contract; and <br />WHEREAS during demolition of the existing structure, the St. Joseph County <br />Commissioners discovered the approach rails are not structurally sufficient to meet <br />current safety requirements. Vehicular damage was present at a large section of the rail <br />and remaining portions of the rail crumbled as adjacent bridge pieces and the historic <br />plaque, which is being stored for future use, were removed. The remaining curved <br />approach railings exhibited exposed reinforcing steel and delaminated and deteriorated <br />concrete; and <br />WHEREAS the St. Joseph County Commissioners discussed the actual condition of the <br />bridge with the Historic Preservation Commission of South Bend and St. Joseph County <br />(HPC). The Commissioners proposed a solution that would meet the safety concerns of <br />the County and at the same time ensure an appropriate rehabilitation of the Angela <br />Boulevard Bridge #211. <br />WHEREAS the HPC requested the opening on the entire bridge railing be changed to <br />match the existing opening shape and the Commissioners have worked with the <br />contractor and has since revised the railing detail to provide an elongated oval opening <br />while maintaining the crashworthy strength as required by FHWA; and <br />WHEREAS on June 16, 2003 the HPC approved a new Certificate of Appropriateness to <br />allow the removal and replacement of the four curved approach railings, and the revision <br />to the entire bridge railing which would change the opening to a simple elongated oval <br />opening; and <br />WHEREAS the St. Joseph County Commissioners have coordinated with the Indiana <br />Department of Transportation, the Indiana State Historic Preservation Officer, and the <br />Federal Highway Administration regarding the proposed modifications to the <br />rehabilitation plan and mitigation measures; and <br />NOW THEREFORE, the FHWA and the Indiana SHPO agree that, upon the <br />submission of a copy of this executed memorandum of agreement, as well as the <br />documentation specified in 36 C.F.R. 800.11(e) and (f) to the Advisory Council on <br />Historic Preservation ( "Council" pursuant to 36 C.F.R. 800.6[b][1][iv]) and upon the <br />FWHA's approval for the Rehabilitation of Angela Boulevard Bridge # 211, the FHWA <br />shall ensure that the following stipulations are implemented in order to take into account <br />the effect of the Rehabilitation of Angela Boulevard Bridge # 211 on historic properties. <br />In the rehabilitation of Bridge #211 the St. Joseph County Board of Commissioners shall <br />ensure that the following mitigation measures are carried out. <br />Mitigation Measures <br />I.
