Covenants and Restrictions to protect Woods in Historic Landmark Area. <br />Should any portion of a subdivided lot fall within the 1.87 acre area encumbered with the <br />Historic Landmark Designation the following Covenants and Restrictions will apply. <br />#. Special Provisions for Lots with Historic Preservation Status. Portions <br />of Lots , and _ are designated as local historic landmarks by the Historic <br />Preservation Commission. The exact portions of those lots are shown on the Plat and <br />shall be considered "Historical Landmark Portions". The Historical Landmark Portion <br />shall be maintained in its natural condition as of the original date of the Plat, except as <br />provided in this paragraph. No improvement shall be constructed on the Historical <br />Landmark Portion. No trees, shrubs or other growth in excess of three feet tall shall be <br />removed unless such vegetation is irreparably damaged by natural causes or has <br />deteriorated such that it presents a significant. danger to individuals or other vegetation. <br />An owner of a Lot that contains a Historic Landmark Portion may modify, improve or <br />otherwise alter that Portion only upon written approval from the Architectural Control <br />Committee and appropriate approval from the Historic Preservation Commission of <br />South Bend and St. Joseph County. Nothing in this paragraph shall restrict the ownership <br />of that section of a Lot not considered a Historical Landmark Portion. <br />
