322 <br />323 MARY JANE CHASE: I second the motion. <br />324 <br />325 After due consideration, the following action was taken: <br />326 <br />327 Upon a motion by Richard Helmus, being seconded by Mary Jane Chase and <br />328 carried unanimously, application 2001-0511 was approved as recommended by staff with <br />329 the stipulations that the stucco is repaired in-kind, the deck is not attached to the house <br />330 and that the new garage door be flat. <br />331 <br />332 7. 548 River Avenue, deck and fence. <br />333 <br />334 RHONDA SAUNDERS: Where will the postholes be dug for the deck? Will they be <br />335 away from the tree? <br />336 <br />337 STEPHEN SHERK: The deck will need to be supported but nothing will be <br />338 mounted into the tree. Some of the postholes will be dug into the root system, however, <br />339 not in a manner that will do any damage to the tree. <br />340 <br />341 RHONDA SAUNDERS: The tree is currently cabled isn't it? <br />342 <br />343 STEPHEN SHERK: Yes, it is. <br />344 <br />345 JOHN OXIAN: You are going around the tree with the deck? <br />346 <br />347 STEPHEN SHERK: Yes. <br />348 <br />349 JOHN OXIAN: Why are you installing a privacy fence on only one side? <br />350 <br />351 STEPHEN SHERK: It will be in between our yard and the neighbors to help <br />352 contain our two-year child. The fence will not be six foot it will be four foot tall. <br />353 <br />354 JOANN SPORLEDER: Have you had any conversations with a professional about <br />355 your tree and the impact the deck would have? <br />356 <br />357 STEPHEN SHERK: I have not; I plan on digging post holes that will be with in <br />358 the safety zone of the tree because it would cost too much to take the tree down. <br />359 <br />360 JOHN OXIAN: To ensure that the deck does not starve the tree of water the back <br />361 four foot by four foot section of the deck should be left out so that plenty of water can <br />362 reach the tree. This is too big of a tree to cover half of it with a deck; at least 3/a of the <br />363 tree should be left uncovered. <br />364 <br />365 STEPHEN SHERK: The only reason for the deck is that we cannot get grass to grow <br />366 because of the dense root bed of the tree. <br />367 <br />8 <br />
