State of Indiana has also recently passed legislation, which created a Farmland <br />Conservation Commission to help preserve farms for future generations. <br />Mr. Oxian followed the regular procedures for landmarking property. He sent <br />the introductory template letter; this letter is very vague because it goes to a variety of <br />different types of properties. He then followed up in person to give a more detailed <br />description of the process and to ascertain the desired number of acres the owner wishes <br />to include. <br />The staff would also like to note that the name of the interested developer is <br />unknown, as are their plans for the property. All that is known is what Mr. Spiers told <br />the staff about the desire of a developer to convert the land for a new subdivision which <br />would include numerous houses. The developer in question has not spoken with or <br />submitted any plans to Area Plan either. The staff also investigated to see if the property <br />was ever listed for sale. Although our sources only go back two years it shows that this <br />particular property was never listed with a real estate agent. The owner has apparently <br />made no attempt to find any other alternative viable economic return for this property. <br />In 1976 the staff obtained permission from the owner, the same owner who, after <br />twenty-five years, has decided to withdraw her support and request removal of landmark <br />designation. Everything was done to ensure owner consent, all standard practices were <br />followed, the importance of the structure has not diminished nor has its architectural <br />integrity. This property should be retained as a landmark if not in its entirety then at least <br />retain the landmark designation for the all structures and the surrounding wooded area. <br />Once again the staff recommends denial of the application as submitted. To <br />approve removal of this property from landmark status would set a bad precedent, <br />especially for other local landmarks located in the County. <br />
