JIUIIISTORIC PRESERVATION COMMISSION, <br />ENFORCEMENT PROCEDURES, <br />2001 <br />The following are procedures, as adopted by the Historic Preservation Commission, for <br />enforcing HPC Code, Standards and Guidelines. <br />Definition of Terms <br />Code = All powers given to Historic Preservation Commission by the City of South Bend and <br />St. Joseph County. <br />Standard = Mandates set forth by the Historic Preservation Commission setting levels <br />pertaining to minimum maintenance of Local Historic Districts and Local <br />Landmarks. <br />Guidelines = Mandates that stipulat ' e the dos and don'ts with in Local Historic Districts and <br />Local Landmarks, as set forth by the Historic Preservation Commission. <br />HPC = Historic Preservation Commission <br />CoA = Certificate of Appropriateness <br />Action to be taken when work commences with no CoA; <br />1) Inspector will go to site. <br />a) Inspector will decide if there is a violation and what type. <br />b) Inspector will red tag the violation requiring that all work be stopped <br />immediately with penalty of fine for failure to comply. <br />1) The red tag will clearly state the violation and that a more <br />detailed notice will be sent via certified mail. <br />c) Inspector will copy the Building Department. <br />2) Notice will be sent by HPC Staff. <br />a) Notice will include the following: <br />1) Detailed description of violation. <br />2) How it violates either HPC Code, Standards and/or Guidelines. <br />3) The owner will be required to file an application for the <br />proposed project by a designated date. <br />4) No work can commence until said application is approved, by <br />either HPC Staff or HPC. <br />
