4 <br />IC 36-7-11. Historic Preservation (Burns) <br />(as amended: 1981, 1982, 1987, 1992) <br />CHAPTER 11 <br />HISTORIC PRESERVATION <br />36-7-11-1. Applicability of chapter -- Exceptions. -- This chapter applies <br />to all units except: <br />(1) Counties having a consolidated city; - <br />(2) Municipalities in counties having a consolidated city; and <br />(3) Townships. <br />36-7-11-2. Exclusive method for operation of historic preservation <br />agency -- Exception -- Power of municipality concerning <br />commission for preservation of historic street. -- (a) If before July <br />1, 1977, a unit established by ordinance a commission for the purpose <br />of historic preservation, that commission may continue to operate, <br />regardless of whether that ordinance is subsequently amended or is <br />consistent with this chapter. If the unit wants to operate an historic <br />district board of review under this chapter, it must adopt an ordinance <br />under section 4 of this chapter, and this chapter then provides the <br />exclusive method for operation of an historic preservation agency in <br />the unit. <br />(b) If a unit did not establish a commission for the purpose of historic <br />preservation before July 1, 1977, this chapter provides the exclusive <br />method for operation of an historic preservation agency in the unit. <br />(c) Subsections (a) and (b) do not limit the power of a municipality to <br />establish a commission for the preservation of an historic street area <br />under IC 14-3-3.2-23. <br />36-7-11-3. Legislative intent -- Conflict between regulations of <br />zoning district and historic district. -- The historic district regulation <br />provided in this chapter is intended to preserve and protect the historic <br />or architecturally worthy buildings, structures, sites, monuments, <br />streetscapes, squares, and neighborhoods of the historic districts. <br />Zoning districts lying within the boundaries of the historic district are <br />subject to the regulations for both the zoning district and the historic <br />district. If there is conflict between the requirements of the zoning <br />district and the requirements of the historic district, the more restrictive <br />V requirements apply. <br />36-7-11-4. Establishment of historic district board of review. -- (a) <br />A unit may establish, by ordinance, an historic district board of review <br />(referred to as "the board" in this chapter), with 'an official name <br />designated in the ordinance. The board must have not less than three <br />(3) nor more than nine (9) voting members, as designated by the <br />ordinance. The voting members shall be appointed by the executive of <br />
