There was more discussion over which parts of the Leeper Park sidewalks were going to be <br />installed. Mr. Talley noted that the staff has proposed that the old street lights, which will be <br />removed from East Wayne Street be installed into Leeper Park, per their original location as <br />depicted in the Works Progress Administration maps of 1938. <br />V. Old Business <br />Mr. Oxian proposed that Mr. Talley be appointed the Commissions permanent director. He <br />noted that he had asked Steve Kennedy from the State Historic Preservation Office, to give his <br />input on this topic. Mr. Kennedy sent a letter to Mr. Oxian commending Mr. Talley in his <br />efficiency and professional manner. Mrs. Sporleder asked if the Commission was legally <br />required to advertise the position. Mr. Talley stated that according to the St. Joseph County <br />Handbook, a vacancy occuring in a department may be filled by promoting a willing and <br />qualified individual from with in that department without having to advertise the position. Mr. <br />Oxian stated that when he asked the County Personnel Director if a position has to be <br />advertised, the director stated that a position may be filled from with in, with, out having to <br />advertise it. He further noted that the Commission only recommends Mr. Talley to become the <br />permanent director and the Common Council makes the final decision. Mrs. DeRose stated that <br />she would like to discuss this issue with the County Attorney, because, according to City <br />guidelines an individual must be apart of the departments staff for the no advertising rule to <br />apply and that taking a member from a Commission is not really promoting from with in. Mr. <br />Oxian stated that according to County Personnel Mr. Talley would qualify as a promotion from <br />with in, but, he would have to resign his position on the Commission. Mrs. Sporleder asked if <br />Mr. Talley meets the necessary qualifications for the job. Mr. Oxian stated that according to the <br />Commissions qualifications Mr. Talley does meet them. Mr. Talley stated that he has been <br />assured by the State Historic Preservation Office, the County Commissioners and the County <br />Personnel Department that he has the necessary qualifications for the job. Mrs. Choitz asked if <br />the Commission is working toward getting the Director a living wage. Mr. Oxian stated that a <br />meeting will be held after January first to discuss this issue. Mrs. Hostetler moved to nominate <br />Mr. Talley as permanent director of the Commission. Mr. Fine seconded the motion. The <br />motion passed unanimously. <br />Mr. Talley noted all the changes in the physical appearance of the office. <br />Mr. Oxian stated that he wanted to appoint a nominating committee, making Jerry Wiener the <br />Chairman and placing Janeanne Petrass as a committee member. <br />V. New Business <br />Mrs. Hostetler stated that the Christmas party would be held after the December 21 st meeting at <br />her house. <br />Mr. Oxian asked why the staff has circulated maps of the East Race to the Commission. Mr. <br />Talley stated that the maps were passed out to keep the Commission members abreast of the <br />staffs activities. He further noted that the maps were submitted to the State Historic <br />Preservation Office on October 14th and are awaiting final acceptance. <br />5 <br />
