CERTIFICATE OF APPROPRIATENESS STAFF REPORT <br />PROPERTY -- 1244 Lincolnway East <br />South Bend, Indiana <br />OWNER -- Ur- Ulrich Klopfer <br />DESIGNATION -- Lincolnway East LHD <br />STATEMENT OF STORIC CONTEXT <br />This former dwelling and retail shop is aa contributing <br />structure (rated C/10) in the Linoolnway East LHD' The <br />structure was built in 1898 in the Queen Anne style. The <br />house has undergone alterations such as they enclosure of <br />the front porch but retains sufficient historical <br />character to remain an important element of the historic <br />district. <br />PROPOSED CHANGE <br />' <br />The Division(�f Code Enforcement of the City of South Bend <br />proposes to demolish *the existing primary structure. The <br />Division seeks demolition pursuant to their public hearing <br />of May 20° 1993 and based on their list of Code <br />Violations dated January 6, 1993' <br />STANDARDS <br />HPC Demolition Standards disfavor demolition and require <br />the Owner (applicant) to prove that it is; economically <br />unfeasible to repair the property appropriately. <br />Section 21-117.2 (2) of the South Bend Code (Article 6'5 <br />n � <br />Historic Preservation Commission) states that ^(`n,)-��\^nQ <br />in this article shall be construed to prevent the' ''. <br />demolition -'' of any building'''which the Building <br />Commissioner or other official having such power may <br />certify as required by the public safety because of an <br />unsafe or dangerous condition'" This; section continues: <br />"(w)here the Historic Preservation Commission deems it <br />necessary, the Commission may petition the Common Council <br />for a temporary delay in the issuance of the required <br />permit(s) for proposed -'- demolition .'' for the purpose <br />of preparing a preservation plan for said landmark' Such a <br />petition must be for a specified period of time. The <br />Common Council shall grant the petition when it finds: <br />a- That such action will not cause the owner of the <br />subject property to suffer hardship; and <br />b' That such a delay will not be injurious to the public <br />health, safety, and welfare: and <br />o. That in keeping with the intent of this article, such <br />action is necessary and appropriate. <br />
