MINUTES OF THE REGULAR MONTHLY MEETING <br />OF THE <br />HISTORIC PRESERVATION COMMISSION <br />October 21, 1991 County Council Caucus Room, #411 <br />7:30 p.m. County/City Building <br />I. Call to Order <br />The meeting was called to order at 7:30 p.m. <br />II. Roll Call <br />Members present: Mrs. Martha Choitz, Mrs. Janeanne <br />Petrass, Mr. Bill Welsheimer, Mr. Herb Herendeen, <br />Mrs. Joanne Sporleder, Mr. Odell Newburn, Mr. John <br />Oxian--President, Mr. Fred Holycross--Director, <br />Mr. James Pastor --Survey Manager, Mrs. Aladean DeRose-- <br />Assistant City Attorney, Suzanne Booker --Surveyor. <br />Members Absent: Mrs. Jean Dennen, Mr. Jed Eide. <br />Also present: Mr. Kevin Boughal--South Bend Tribune, <br />Ms. Jane Parker --Beavers Construction, Mr. Terry Beaver -- <br />Beavers Construction, Ms. Susan Metzger --homeowner, <br />Ms. Ginny Toal--homeowner. <br />III. Public Hearing <br />A. Certificates of Appropriateness. <br />1. 1716 E. Wayne--LHD <br />Mr. Pastor reported that a C of A committee had met <br />August 29. The owner, Susan Metzger, had submitted <br />an application for installing a Schuell San Fernando <br />style fence. Mr. Pastor passed around photos of <br />the fence. The committee's recommendation, he said, <br />was to approve the fence pending removal of the two <br />front -most bays; the gate was to be moved back to <br />the rear corner of the east facade. <br />Ms. Metzger then stated her case. She said she had <br />reviewed the guidelines carefully and noted a <br />reference which allowed fences to be constructed <br />provided they didn't extend beyond the front line <br />of the house. She cited p. 43 of the guidelines, <br />saying the opening paragraph omitted mention of <br />structures as minor as fences. She had concluded <br />that building the fence was therefore permissible <br />without applying for a C of A. She further stated <br />that the reason the fence was so positioned was so <br />that she could let her dogs in and out without <br />going outside herself. <br />Mr. Oxian asked Mrs. DeRose for a legal opinion. <br />
