Motion approved. <br />Regarding the C. of A. procedures, Mr. <br />Oxian suggested that. at the <br />recommendation of Ms. DeRose, that the <br />Commission postpone any motion on the <br />procedures until the December meeting to, <br />allow the Common Council adequate time tc <br />review the proposed procedures. <br />C. Tree on Lincoln Way East <br />Mr. Oxian reported that a tree in the <br />Edgewater Historic District, in front of <br />an establishment called "Phil's Place" is <br />dead. He suggested that the owner be <br />contacted to remove the tree and plant <br />something else or to do something with <br />the dead tree. He believes the address <br />is 725 or 723 Lincoln Way East. <br />Mrs. Sporleder asked what would be the <br />grounds for the staff contacting the <br />owner; what should the staff say to the <br />owner. Mr. Oxian stated that the HPC can <br />ask the owner to remove the tree. They <br />can not be forced to because the <br />maintenance clause is not yet in the <br />ordinance. <br />Mrs. Choitz reminded the Commission that <br />it is not dealing with hazards or other <br />matters pertaining to public safety. The <br />appearances would be the grounds upon <br />which the HPC's recommendation would be <br />based. <br />Mrs. Dixon stated that the owner could be <br />informed that he is welcome to remove the <br />tree if he so desires, as long as he <br />contacts the Commission for the <br />appropriate permit. <br />In an aside, Mr. Herendeen asked how the <br />sewer project in Edgewater Place had <br />turned out. Mrs. Dixon stated that it <br />had been completed, but that she had not <br />
