Nussbaum, II, City Attorney <br />October 2, 1990 <br />Mr. John Oxian <br />President, Historic <br />Preservation Commission <br />1533 Lincolnway West <br />South Bend, IN 46628 <br />Dear Mr. Oxian: <br />At the last meeting of the South Bend Historic Preservation <br />Commission, you gave me a draft of "Certificate of Appropriateness <br />Procedures." I have had a chance to review them carefully, and I have <br />also reviewed carefully general law concerning historic preservation. <br />I have expanded the procedures considerably as you will notice <br />from the enclosed draft. <br />Although most of these things are not mentioned in the current <br />preservation plan for the City of South Bend, they are typical of <br />procedures governing historic commissions in other areas, and they do <br />conform to the purpose, intent, and statutory authority for local <br />historic preservation commissions in the State of Indiana. <br />To adopt these procedures would be, I think, a substantial <br />undertaking on the part of the Commission. For this reason, they <br />should be reviewed quite carefully by you and by all members of the <br />Commission before they are enacted. <br />You will note that in Section VI(D), I have not inserted any <br />notice requirements for public hearings. I do not know what your <br />procedure has been in the past.
