It may not be modified, changed or rescinded in any manner except <br />by written agreement of both Schuell Fence and the Purchaser. It is contingent upon delays due to strikes, fire, accidents and/or other causes beyond the control of the Seller. <br />Ok <br />2. This contract is payable in full upon invoice after substantial completion of this work to be performed by Schuell Fence Company pursuant to this contract. This is a cash sale and Purchaser has <br />no right to defer payment past the due date. The parties agree that, in the event Purchaser does not pay the balance to Seller when specified above. the delinquent amount shall BEAR INTEREST <br />OF 1112% PER MONTH (which is an annual percentage rate of 18%). Purchaser agrees he shall be liable for all court costs, Attorney's fees, and other expenses incurred by Schuell Fence Company <br />in the collection of any amount due it for work performed or material supplied persuant to this contract. <br />3. All proposals, including installation by the Seller. are made on the condition that the entire work be completed without interruption by the Purchaser. Any changes initiated by the Purchaser are <br />subject to additional charges. <br />4. Priorto commencement of performance by Seller pursuant to this contract. Purchaser shall furnish Seller with sufficient evidence as to the exact locations upon Purchaser's real property of all property <br />line stakes and grade stakes, as well as all underground lines and pipes including but not limited to all television cable lines, gas lines for grilling, barbecuing or other like purposes and such pipes or <br />lineswhich are used as part of an underground sprinkling system- Seller shall not be responsible or liable to Purchaser or anyone else for damages resulting from inaccurate information given Seller <br />by Purchaser as to the exact locations of such lines and pipes. Purchaser shall also indemnity and save Seller harmless from any liability of Seller resulting from such inaccurate information. Excepted <br />from this required information due Seller from Purchaser, is that information which is readily given by the various utility companies concerning the locations of ordinary and usual public utility lines such <br />as public telephone and public electric lines. Purchaser shall also be responsible for obtaining any public permits which may be applicable and hold Seller harmless for failure to obtain such. <br />5.
