SCHWARTZ (- <br />SUBJECT: ISSUANCE OF STOP WORK ORDERS BY BUILDING COMMISSIONER <br />I have consulted the Indiana Construction Rules, 1980 <br />edition, and the South Bend Municipal Code Section 6-4, to determine <br />whether the Building Commissioner has the authority to issue stop <br />work orders where work on a building or structure is occurring in <br />violation of Section 21-117.2, where no violation of Chapter 6, <br />entitled Buildings, of the South Bend Municipal Code, or any of the <br />codes incorporated therein, can be determined to have occurred. It <br />is the opinion of this office that the Building Commissioner does <br />not have power to issue a stop work order unless a violation of the <br />provisions of Chapter 6 of the South Bend Municipal Code, or the <br />Indiana Construction Rules, 1980 edition, is involved. <br />ESS/clt/11 <br />cc: Katherine Barnard <br />
