In your letter you asked the
to use the legal means available to him to repair
219/284-9488
219/284-9325
the house at
Building Commissioner
the building.
The legal means available to the Department of Code Enforcement to
repair the structure are as follows:
1. The Department of Code Enforcement can hire a contractor to make
the exterior repairs on the structure and charge the property owner
for the cost of the repairs.
2. A receiver can be appointed to rehabilitate the property and manage
the property until the costs of the rehabilitation are recovered.
The receiver must be a not-for-profit agency or individual who would
appointed by the Court to make the repairs on the property and be
responsible for renting the property, thus generating income to pay
the rehabilitation. After the property has been rehabilitated, and
the cost of the repairs have been repaid, the property would then be
returned to the property owners. It is reasonable to assume that a
property could be involved in a receivership for several years.
Please let me know which option the Historic Preservation would find
most acceptable.
be
for
