APPENDIX A "of Historic Landmarks and of buildings or structures within Historic Preservation Districts." Section 7. Section 26.78.120 of the St. Joseph County Code is hereby amended to read as follows: 26.78.120 Requests to County Council to delay alteration of historic landmarks. A. Where the Historic Preservation Commis- sion deems it necessary, the Commission may petition the legislative -body County Council for a temporary delay in the issuance of the required permit(s) for proposed construction, reconstruction, alteration, demolition, or moving of a desig- nated historic landmark for the purpose of preparing a preservation plan for said landmark. Such request petition shall be for a specified period of time, and in no case shall the request exceed one (1) year. B. The legislative -beefy County Council shall grant the Commission's request petition when it finds that: 1. Such action will not cause the owner of the subject property to suffer hardship; and 2. Such delay will not be injurious to the public health, safety, or welfare; and 3. In keeping with the intent of this chapter, such action is necessary and appropriate. In no case may the delay granted by the County Council exceed one (1) year, but the Commission may petition the County Council for a continuance of any such delay granted by the County Council in accordance with the same procedures set forth above for,the initial petition. Section 8. The St. Jospeh County Code is hereby amended by the addition thereto by the following new section: 26.78.130 Gifts, grants, legacies, bequests, and endowments. The Historic Preservation Commission may accept throgh gift, grant, legacy, bequest, or endowment, monies and preservation easements in real property for the purpose of the preservation of historic landmarks and Historic Preservation Districts. Expenditures of such money, regardless of the source, must be deposited in a special Historic Preservation Commission account, and receive prior approval from the County Council before expenditures may be made.
