APPENDIX A <br />"of Historic Landmarks and of buildings or structures <br />within Historic Preservation Districts." <br />Section 7. <br />Section 26.78.120 of the St. Joseph County Code is <br />hereby amended to read as follows: <br />26.78.120 Requests to County Council to delay alteration of <br />historic landmarks. A. Where the Historic Preservation Commis- <br />sion deems it necessary, the Commission may petition the <br />legislative -body County Council for a temporary delay in the <br />issuance of the required permit(s) for proposed construction, <br />reconstruction, alteration, demolition, or moving of a desig- <br />nated historic landmark for the purpose of preparing a <br />preservation plan for said landmark. Such request petition <br />shall be for a specified period of time, and in no case shall <br />the request exceed one (1) year. <br />B. The legislative -beefy County Council shall grant the <br />Commission's request petition when it finds that: <br />1. Such action will not cause the owner of the <br />subject property to suffer hardship; and <br />2. Such delay will not be injurious to the public <br />health, safety, or welfare; and <br />3. In keeping with the intent of this chapter, such <br />action is necessary and appropriate. <br />In no case may the delay granted by the County Council <br />exceed one (1) year, but the Commission may petition the County <br />Council for a continuance of any such delay granted by the <br />County Council in accordance with the same procedures set forth <br />above for,the initial petition. <br />Section 8. <br />The St. Jospeh County Code is hereby amended by the addition <br />thereto by the following new section: <br />26.78.130 Gifts, grants, legacies, bequests, and endowments. <br />The Historic Preservation Commission may accept throgh gift, <br />grant, legacy, bequest, or endowment, monies and preservation <br />easements in real property for the purpose of the preservation <br />of historic landmarks and Historic Preservation Districts. <br />Expenditures of such money, regardless of the source, must <br />be deposited in a special Historic Preservation Commission <br />account, and receive prior approval from the County Council <br />before expenditures may be made. <br />(3) <br />
