CONTINUING WITH HOOVER STREET, NOW KNOWN AS HOMER AVENUE, <br />FROM THE EAST RIGHT OF WAY OF MAIN STREET TO THE WEST RIGHT OF <br />WAY OF THE ST. JOSEPH VALLEY PARKWAY (US 20/31 BY-PASS) FOR A <br />DISTANCE OF 30 FEET, MORE OR LESS AND A WIDTH OF 20, FEET MORE OR <br />LESS. BEING A PART OF PLEASANT VIEW MANOR ADDITION AND AUTEN'S <br />PROPOSED SUBDIVISION TO THE CITY OF SOUTH BEND, ST. JOSEPH <br />COUNTY, INDIANA. <br />hereby determines that it is desirable to vacate said property. <br />SECTION II. The City of South Bend hereby reserves the rights and easements <br />of all utilities and the Municipal City of South Bend, Indiana, to construct and <br />maintain any facilities, including, but not limited to, the following: electric, <br />telephone, gas, water, sewer, surface water control structures and ditches, within <br />the vacated right-of--way, unless such rights are released by the individual utilities. <br />SECTION III. The following properties may be injuriously or beneficially <br />affected by such vacating: <br />Tax ID numbers: <br />23-1030-1600.02, 23-1030-1601, 23-1030-1602, 23-1030-1603, 23-1030-1605, 23-1030- <br />1607, 23-1030-1609, 23-1030-1610, 23-1030-1611, 23-1030-1612, 23-1030-1613, 23- <br />1030-1614, 23-1030-1615, 23-1030-1617, 23-1030-1619, 23-1030-1620, 23-1030-1621, <br />23-1030-1622, 23-1030-1623, 23-1030-1624, 23-1030-1625 and 23-1030-1628. <br />SECTION IV. The purpose of the vacation of the real property is to: <br />Facilitate the development of a 430,000 square foot retail center to be_developed <br />on and adjacent to the streets to be vacated. <br />SECTION V. This ordinance shall be passed by the Common Council and be in <br />full force and effect upon receiving a resolution being filed for Common Council <br />consideration by the Administration which addresses the progress of the proposed <br />construction related to the Anchor Retail project.
