Byorni <br />Executive Director Assistant Director <br />Phone 574 235-9571 Fax 574 235-9813 <br />April 21, 2004 <br />The Honorable Council of the City of <br />South Bend <br />4th Floor, County-City Building <br />South Bend, IN 46601 <br />RE: A proposed ordinance and site development plan of Woodhaven LLC to zone from "A" <br />Residential and "C" Commercial, "A" Height and Area to "C" Commercial, "A" Height and <br />Area and "CB" Community Business District, property located on the south side of Prairie <br />Avenue, approximately 195 feet northeast of Olive Street, City of South Bend - APC# <br />2257-04 <br />Dear Council Members: <br />I hereby Certify that the above referenced ordinance of Woodhaven LLC was legally advertised <br />on Thursday, Apri18, 2004 and that the Area Plan Commission at its public hearing on Tuesday, <br />Apri120, 2004, and the Commission took the following action: <br />Upon a motion by John DeLee, being seconded by Roland Kelly and unanimously <br />carried, the proposed ordinance and site development plan of Woodhaven LLC to <br />zone from "A" Residential and "C" Commercial, "A" Height and Area to "C" <br />Commercial, "A" Height and Area and "CB" Community Business District, property <br />located on the south side of Prairie Avenue, approximately l95 feet northeast of <br />Olive Street, City of South Bend is sent to the Common Council with a favorable <br />recommendation, subject to a Final Site Development Plan. This site is adjacent to <br />current commercial uses and is along a major city street. Although this site is also <br />adjacent to residential land, developing to the standards of the new ordinance will <br />greatly increase the amount of screening and buffering between this commercial <br />development and any current or future residential development. <br />PLEASE NOTE that the Ordinance has been amended by the petitioner to show a zoning district <br />different than that used for the Common Council's first reading. The amended Ordinance legally <br />advertised and heard by the Area Plan Commission. <br />The deliberations of the Area Plan Commission and points considered in arriving at the above <br />decision are shown in the minutes of the public hearing, and will be forwarded toto vTua_ralate~-• <br />date to be made a part of this report.
