Selection by a lottery pool: of Company employees to be administered <br />by an independent agent. <br />6.3.1.4. Any Company employee who returns to work following rehabilitation <br />or other form of appropriate counseling shall be subject to a <br />reasonable program of follow-up testing without prior notice for thirty- <br />six (36) months after his or her return to duty. <br />6.3.2. Substance testing shall, at a minimum, be conducted for alcohol, marijuana, <br />cocaine, opiates amphetamines and phencyclidine. <br />6.3.3. When conducting reasonable suspicion, post -accident for unsafe practice <br />testing, testing may be conducted for any drug listed in Schedule I or II of the <br />Controlled Substances Act. <br />6.3.4. In addition, reasonable suspicion testing can be conducted at the job site <br />utilizing instant test. These tests are non -binding for results unless confirmed <br />by tests that meet the requirement of this policy. In the event, a positive test <br />results during the administration of an instant test, that person is required to <br />report for a confirmatory test as soon as possible. <br />6.4. Administration: <br />6.4.1. Because of the importance of ensuring that Company employees are fit -for - <br />duty while on a job site or on company property, the substance testing is <br />delegated to an Company agent <br />6.4.2. The Company specifies only those laboratories that are certified by the <br />Department of Health and Human Services (DHHS) shall be used to perform <br />substance testing. <br />6.4.3. The Company shall use as a guideline the DHHS "Mandatory Guidelines for <br />Federal Workplace Drug Testing Programs", and subsequent amendments <br />hereto. These guidelines shall be administered by a third -party administrator <br />engaged on behalf of the Company and shall cover split specimen collection <br />procedures, chain -of -custody procedures, and laboratory qualifications, testing <br />methodologies, quality control procedures, and reporting requirements. <br />6.4.4. The initial test of breath for alcohol performed at the collection site shall be <br />conducted using an evidential -grade breath alcohol analysis device of a brand <br />and model that conforms to National Highway Traffic Safety Administration <br />(NHTSA) standards and to any applicable State statutes. An alcohol breath <br />test will be deemed positive when the blood alcohol concentration is at or <br />Page 7 of 22 <br />
