Positive Alcohol Test - A test with a result indicating the presence of alcohol at or in <br />excess of 0.04% BAC or BrAC or such level in the future that may be established by <br />the U.S. Department of Transportation as the allowable limit of blood alcohol content. <br />3.15. Prescribed on Over- the- Counter Medication - Medication normally taken for medicinal <br />or other legitimate reasons, consistent with directions of a physician or, in the case of <br />over-the-counter medication, consistent with the directions on the package <br />4. Responsibilities <br />4.1. Management — Oversees and provides executive guidance for yearly safety procedure <br />review and the means for all employees to obtain proper training and equipment <br />necessary to abide by this program. <br />4.2. Safety Director/Safety Personnel — Administers and provides guidance for the written <br />Drug and Alcohol Program, directs personnel on proper implementation of its <br />requirements, and provides periodic review of the company's program and related <br />training process. <br />4.3. Superintendent/Foreman — Responsible for implementing the program in their area, <br />ensuring that the program is understood and followed by the employees under their <br />charge, and directing the work in such a manner that risk to employees is minimized <br />and adequately controlled. Superintendents and foremen are also responsible for <br />ensuring the written compliance program is available on the job -site and ensures <br />appropriate control methods are implemented <br />4.4. Employees — Responsible for ensuring that they fully understand and comply with all <br />requirements of this program. Employees are to ensure they are properly trained and <br />equipped prior to working. <br />5. Requirements <br />5.1. The requirements outlined in this procedure shall be considered the minimum <br />acceptable. Employees shall comply with any additional requirements of the Company, <br />Branch, Clients, Local, State, and Federal Laws. <br />6. Procedure <br />6.1. Prescribed or Over- the- Counter Medication <br />6.1.1. It is the employee's responsibility to inform his or her supervisors of any <br />prescribed or over-the-counter medication, which may affect or impact the <br />employee's ability to properly or safely, perform job responsibilities.
