NEW BUSINESS (Cont.) <br />q. continued... <br />That counter offer had the following <br />conditions: 1) the Commission must provide <br />Azar's with a survey of the ten parking <br />spaces in which Azar's will retain a parking <br />easement, certified to a date no later than 60 <br />days prior to closing; 2) the Commission <br />must provide title insurance insuring Azar's <br />interest in the ten parking spaces which <br />Azar's will retain; 3) the Commission must <br />release all of its turn- around and <br />maneuvering easement rights in Azar's <br />property; 4) Azar's and the Commission <br />shall file a joint motion for dismissal with <br />prejudice in their litigation; and 5) Azar's <br />and the Commission shall execute mutual <br />releases which release each party from all <br />claims arising out of the litigation. The staff <br />recommends accepting the counter offer. <br />Upon a motion by Mr. Faccenda, seconded COMMISSION ACCEPTED THE COUNTER <br />by Mr. Donoho and unanimously carried, OFFER FROM AZARS, INC. FOR AN <br />the Commission accepted the counter offer EASEMENT ADJACENT TO THE <br />from Azars, Inc. for an easement adjacent to STEPHENSON MILL BUILDING <br />the Stephenson Mill building. <br />7. PROGRESS REPORTS <br />There were no Progress Reports. <br />8.
